That Section 30-43 of Division 4, Sewage System <br />Capital Recovery Fee, of Article II of Chapter 30 of the Code of <br />Ordinances of the City of San ~larcos, Texas, is hereby amended to <br />read as follows: <br /> <br />Sec. 30-43. Time of payment. <br /> <br />Effective November 1, 1986, the capital recovery fees <br />for new construction shall be paid in full prior to the <br />issuance of the building permit for the building, premise <br />or lot to be added to the sewerage system except, that <br />upon a request in writing by the owner to the City Manager <br />prior to the issuance of said permit, an owner shall be <br />allowed to pay fifty percent (50%) of said capital <br />recovery fees prior to the issuance of the building permit <br />and the remaining fifty percent (50%) prior to the <br />issuance of the certificate of occupancy for said <br />building, premise or lot. No prepayment shall be allowed <br />except as may be provided under conditions specified in <br />Section 30-49. <br /> <br />SECTION 2. That Subsection 5 of Section 30-45 of Division <br />4, Sewage System Capital Recovery Fee, of Article II of Chapter 30 <br />of the Code of Ordinances of said City is hereby amended, effective <br />November 1, 1986, to read as follows: <br /> <br />Sec. 30-45. Computation of living unit equivalents for <br />various permitted uses. <br /> <br />Type of Use <br /> <br />LUE per Unit of Development <br /> <br />( 5) <br /> <br />Restaurant/Bar <br /> <br />0.001 LUE/ sq. ft. of bldg. <br />plus LUE annual fee <br />calculated as follows: <br /> <br />SECTION 3. That Section 30-63 of Division 5, Water System <br />Capital Recovery Fee, of Article II of Chapter 30 of the Code of <br />Ordinances of the City of San Marcos, Texas, is hereby amended to <br />read as follows: <br />
