1"\ U LI.J C:ì 18 ORDINANCE 1986-144 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 30-43 OF DIVISION 4, SEWAGE SYSTEM CAPITAL RECOVERY FEE, OF ARTICLE II OF CHAPTER 30 OF THE CODE OF ORDINANCES OF SAID CITY TO ALLOW PAYMENT OF CAPITAL RECOVERY FEES IN TWO INSTALLMENTS, AMENDING SUBSECTION 5 OF SECTION 30-45 OF SAID DIVISION 4 OF SAID ARTICLE II OF SAID CHAPTER OF SAID CODE TO AMEND THE FACTOR TO BE USED TO COMPUTE LUE'S FOR RESTAURANT/BAR USES OF PROPERTY FRm-1 .0046 LUE/ SQUARE FOOT OF BUILDING TO .001 LUE/SQUARE FOOT OF BUILDING, AMENDING SECTION 30-63 OF DIVISION 5, WATER SYSTEM CAPITAL RECOVERY FEE, OF ARTICLE II OF CHAPTER 30 OF THE CODE OF ORDINANCES OF SAID CITY TO ALLOW PAYMENT OF CAPITAL RECOVERY FEES IN TWO INSTALLMENTS, AMENDING SUBSECTION 5 OF SECTION 30-65 OF SAID DIVISION 5, OF SAID ARTICLE II OF SAID CHAPTER OF SAID CODE TO AMEND THE FACTOR TO BE USED TO COMPUTE LUE I S FOR RESTAURANT/BAR USES OF PROPERTY FROM .003 LUE/SQUARE FOOT OF BUILDING TO .001 LUE/SQUARE FOOT OF BUILDING, AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 30-43 of Division 4, Sewage System Capital Recovery Fee, of Article II of Chapter 30 of the Code of Ordinances of the City of San ~larcos, Texas, is hereby amended to read as follows: Sec. 30-43. Time of payment. Effective November 1, 1986, the capital recovery fees for new construction shall be paid in full prior to the issuance of the building permit for the building, premise or lot to be added to the sewerage system except, that upon a request in writing by the owner to the City Manager prior to the issuance of said permit, an owner shall be allowed to pay fifty percent (50%) of said capital recovery fees prior to the issuance of the building permit and the remaining fifty percent (50%) prior to the issuance of the certificate of occupancy for said building, premise or lot. No prepayment shall be allowed except as may be provided under conditions specified in Section 30-49. SECTION 2. That Subsection 5 of Section 30-45 of Division 4, Sewage System Capital Recovery Fee, of Article II of Chapter 30 of the Code of Ordinances of said City is hereby amended, effective November 1, 1986, to read as follows: Sec. 30-45. Computation of living unit equivalents for various permitted uses. Type of Use LUE per Unit of Development ( 5) Restaurant/Bar 0.001 LUE/ sq. ft. of bldg. plus LUE annual fee calculated as follows: SECTION 3. That Section 30-63 of Division 5, Water System Capital Recovery Fee, of Article II of Chapter 30 of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to read as follows:
