Credit for Prior Pa~nts: If the Owner has made pay8ents to the Eng1neel" under that contract of May 7, 1979 or any subsequent amendlents thereto for any servfces covered under this contract prior to the execution of this contract, such payments shall be credited toward any payments due under this contract. 4. Federal Environmental Requirements: The ørov1s10ns establ1shed by the Environmental Protection Agency, known as Contract Provisions required by Section 33.1030, 40 CFR, Part 33, as published in the Federal Register (May 12, 1982), are part of this Agreement. These provisions are attached as Attachment D. It 15 mutually agreed that all references to other paragraphs in t~e Federal Regulatfons and Guidelines shall refer to those in effect at the ti me of executi on of thi s Contract. The Engi neer ~ill endeavor to meet the guidelines of the Environmental Protection Agency, Region IV for Minority and Women Bus1ness Employment, and will keep the Owner advised as to these matters through the Project. 5. Preliminary Estimates: The Engineer witt furnish estimates of probable constructi on cost of the work, but he does not guarantee the accuracy of such estimates. 6. Revision of Plans and Specifications: The Owner reserves the right to direct substantial revision of the Plans and Specifications after due approval by the Owner as Owner may deem necessary, but in such event the Owner shalt pay to the Engineer just and equitable compensation for services rendered in making such revisions. If revisions in the Plans, Specifications or drawings are required by reason of the Engineer's error or amiss ion, then such revi 51 ons wi 11 be made by the £n91 neer wi thout additional compensation to the fees herein specified. 7. Inspection and Review of the Work: The Engineer will endeavor to protect the Owner against defects and deficiencies in the work of Contractors, by inspection and observation of the work as it progresses, by interpretation of the Plans, Specifications and other contract documents to and ~i th the Contractors, by th,. disappro.val of defective work and the issuance of stop-orders by the Owner ~ith respect to defective procedures, where they are observed, and the Engi neer will exerci se due di 1 i gence to assist the Owner in requiring that the work be done in accordance with Plans and Specifications; but the Contractor will remain independent contractor wi th the Owner, and the Engi neer does not guarantee the performance of such construction contracts, except to the extent that Engineer is responsible for exercising reasonable care and diligence in inspecting and reviewing the construction work. 6
