84 PARKING SPACE LEASE STATE OF TEXAS § § KNOW ALL PERSONS BY THESE PRESENTS, THAT: COUNTY OF HAYS § This Parking Lease Agreement is made this 28 day of January , 19 85 , by and between the City of San Marcos hereinafter referred to as Lessor and Indifree Investments, Inc. hereinafter referred to as Lessee, as follows: WHEREAS, Indifree Investments, Inc. has heretofore purchased that certain real property with improvements located on Guadalupe Street in San Marcos, Hays County, Texas, known as the "Old Fire House and City Hall"¡ and, WHEREAS, for said property to be useful it is necessary for Lessee to obtain certain parking space for utilization with said building¡ and, "'¡HEREAS, the City of San Marcos has currently located, adjacent to and along the east boundary line of said building, its Fire Station and parking lot therefor adjoining the property of Indifree Investments, Inc. as above described¡ and, WHEREAS, the City of San Marcos desires to obtain paving for said parking lot and to assist Lessee in rehabilitation and use of the former San Marcos Fire House and City Hall: and, WHEREAS, Lessee is amenable to paving said parking lot and paying rental for parking adjoining said building: NOW, THEREFORE, it is agreed by and between the parties that Indifree Investments, Inc. shall lease the property as below described from the City of San Marcos upon terms and conditions hereinafter set forth and that the City of San Marcos shall lease the same to Indifree Investments, Inc. upon said terms and conditions: 1. Property Lease. Indifree Investments, Inc. shall lease from the City of San Marcos four (4) automobile parking spaces, together with access thereto and to the north side of the Old Fire House, upon the current City Fire Station parking lot adjoining the east side of the property described, said parking spaces being designated as T-l, T-2, T-3, and T-4 upon the plat attached hereto as Exhibit A and made a part hereof by reference for all purposes. 2. Price For Rental. The price for the rental of the parking spaces above described sha 11 be the sum of $10.00 per parking space allocated to Lessee, per month, subject to adjustment according to the consumer price indexes below set forth. It is understood and agreed between the parties, however, that Lessee shall pave the described Fire Station parking lot in a usual and customary manner and stripe the same in accordance with the plat attached hereto as Exhibit A and that, to the extent of the cost of paving and striping to Lessee, the City of San Marcos shall apply said cost as an off-setting credit to sums that may become due and payable by Lessee upon said lease. Otherwise stated, Lessee shall pay to Lessor the sum of $40.00 per month for the parking spaces allocated to Lessee, however, all sums expended by Lessee in paving and striping of said parking lot shall be a credit against these payments that may become due or payable during the term of the lease and until all of said sums so expended
