<br /> 84 <br /> PARKING SPACE LEASE <br /> STATE OF TEXAS § <br /> § KNOW ALL PERSONS BY THESE PRESENTS, THAT: <br /> COUNTY OF HAYS § <br /> This Parking Lease Agreement is made this 28 day <br /> of January , 19 85 , by and between the City of San <br /> Marcos hereinafter referred to as Lessor and Indifree <br /> Investments, Inc. hereinafter referred to as Lessee, as <br /> follows: <br /> WHEREAS, Indifree Investments, Inc. has heretofore <br /> purchased that certain real property with improvements <br /> located on Guadalupe Street in San Marcos, Hays County, <br /> Texas, known as the "Old Fire House and City Hall"¡ and, <br /> WHEREAS, for said property to be useful it is necessary <br /> for Lessee to obtain certain parking space for utilization <br /> with said building¡ and, <br /> "'¡HEREAS, the City of San Marcos has currently located, <br /> adjacent to and along the east boundary line of said <br /> building, its Fire Station and parking lot therefor adjoining <br /> the property of Indifree Investments, Inc. as above <br /> described¡ and, <br /> WHEREAS, the City of San Marcos desires to obtain paving <br /> for said parking lot and to assist Lessee in rehabilitation <br /> and use of the former San Marcos Fire House and City Hall: <br /> and, <br /> WHEREAS, Lessee is amenable to paving said parking lot <br /> and paying rental for parking adjoining said building: <br /> NOW, THEREFORE, it is agreed by and between the parties <br /> that Indifree Investments, Inc. shall lease the property as <br /> below described from the City of San Marcos upon terms and <br /> conditions hereinafter set forth and that the City of San <br /> Marcos shall lease the same to Indifree Investments, Inc. <br /> upon said terms and conditions: <br /> 1. Property Lease. Indifree Investments, Inc. shall <br /> lease from the City of San Marcos four (4) automobile parking <br /> spaces, together with access thereto and to the north side of <br /> the Old Fire House, upon the current City Fire Station <br /> parking lot adjoining the east side of the property <br /> described, said parking spaces being designated as T-l, T-2, <br /> T-3, and T-4 upon the plat attached hereto as Exhibit A and <br /> made a part hereof by reference for all purposes. <br /> 2. Price For Rental. The price for the rental of the <br /> parking spaces above described sha 11 be the sum of $10.00 per <br /> parking space allocated to Lessee, per month, subject to <br /> adjustment according to the consumer price indexes below set <br /> forth. It is understood and agreed between the parties, <br /> however, that Lessee shall pave the described Fire Station <br /> parking lot in a usual and customary manner and stripe the <br /> same in accordance with the plat attached hereto as Exhibit A <br /> and that, to the extent of the cost of paving and striping to <br /> Lessee, the City of San Marcos shall apply said cost as an <br /> off-setting credit to sums that may become due and payable by <br /> Lessee upon said lease. Otherwise stated, Lessee shall pay <br /> to Lessor the sum of $40.00 per month for the parking spaces <br /> allocated to Lessee, however, all sums expended by Lessee in <br /> paving and striping of said parking lot shall be a credit <br /> against these payments that may become due or payable during <br /> the term of the lease and until all of said sums so expended <br />
