<br /> 91 <br /> RESOLUTION 1984-l4R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS DECLARING THE NECESSITY <br /> OF ACQUIRI~G REAL PROPERTY FOR A PUBLIC <br /> PURPOSE, TO-WIT: FOR THE INSTALLATION AND <br /> MAINTENANCE OF ELECTRICAL AND ELECTRONIC <br /> EQUIPMENT AND STRUCTURES TO PROVIDE PRECISION <br /> APPROACH PROCEDURES TO AIRCRAFT UTILIZING <br /> RUNWAY 12 AND FOR A CLEAR ZONE EASEMENT AT THE <br /> SAN MARCOS MUNICIPAL AIRPORT; AUTHORIZING AND <br /> DIRECTING THE CITY ATTORNEY TO ACQUIRE SUCH <br /> PROPERTY THROUGH VOLUNTARY ACQUISITION OR TO <br /> INSTITUTE EMINENT DOMAIN PROCEEDINGS THEREFQR <br /> AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, it is necessary that the City of San Marcos, <br />Texas acquire fee simple title to a 2.923 acre tract of land, <br />being out of and a part of that 132.65 acre tract out of the <br />T.G. McGehee Survey in Hays County, Texas, said 2.923 acre <br />tract being more particularly described by metes and bounds <br />in Exhibit A which is attached hereto and made a part hereof <br />for all purposes, for a public purpose, to-wit: the <br />installation and maintenance of electronic and electrical <br />equipment and structures to provide precision approach <br />procedures to aircraft utilizing Runway 12 of the municipal <br />airport of said City; and, <br /> WHEREAS, it is necessary that the City of San Marcos, <br />Texas acquire a clear zone easement in a 45.762 acre tract of <br />land, being out of and a part of that 132.65 acre tract out <br />of the T.G. McGehee Survey in Hays County, Texas, said 45.762 <br />acre tract being more particularly described in Exhibit B <br />which is attached hereto and made a part hereof for all <br />purposes, for a public purpose, to-wit: a clear zone to <br />provide control and rights to the air space within the <br />approach surface to Runway 12 of the municipal airport of <br />said City; and, <br /> WHEREAS, the City Council of the City of San Marcos, <br />Texas hereby finds that the acquisition of such property is <br />in the interest and to the benefit of the citizens of San <br />Marcos, Texas; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARÇOS, TEXAS: <br /> PART 1. That a public purpose, to-wit: the <br />installation and maintenance of electronic and eleétrical <br />equipment and structures to provide precision approach <br />procedures to aircraft utilizing Runway 12 of the municipal <br />airport of said City, exists which makes necessary the <br />acquisition by said City of a 2.923 acre tract of land, being <br />out of and a part of that 132.65 acre tract out of the T.G. <br />McGehee Survey in Hays County, Texas, said 2.923 acre tract <br />being more particularly described by metes and bounds in <br />Exhibit A which is attached hereto and made a part hereof for <br />all purposes. <br /> PART 2.
