<br /> -6- <br />be maintained according to generally accepted accounting principles. <br />City or its duly authorized representatives s11all have the right at all <br />reasonable times during business hours to inspect the books, records <br />and receipts of Lessee, and to verify Lessee's adjusted gross receipts. <br />F. ANNUAL STATEMENT. Within sixty (60) days after the end of each <br />fiscal year, Lessee shall furnish to City a statement of adjusted gross <br />receipts generated during the preceding fiscal year, certified by an <br />officer of Lessee as to its correctness. City reserves the right to <br />audit said statement and Lessee's books and records, including <br />examination of the general ledger and all other supporting material, at <br />any reasonable time during business hour, for purpose of verifying the <br />adjusted gross receipts. <br /> If the audit establishes the Lessee has understated or overstated <br />adjusted gross receipts, by 5% or more, the entire expense of said <br />audit shall be borne by Lessee. Any additional payment due from Lessee <br />shall forthwith be paid by Lessee, with interest thereon at 1. 5% per <br />month from the date such amount originally became payable by Lessee. <br />Any overpayment by Lessee shall be credited against further payments <br />due to City. Either party may refer the results of the audit for <br />resolution in accordance with Paragraph G. below. <br />G. DISPUTES. In the event that any dispute may arise as to adjusted <br />gross receipts, the amount claimed due by City shall be paid forthwith <br />and the dispute shall be submitted to a certified public accountant, <br />agreeable to both parties, who shall determine the rights of the <br />parties hereunder in conformity with generally accepted accounting <br />principles. The fees due said accountant for such service shall be <br />paid by the unsuccessful party, or in the event the determination is <br />partially in favor of each party, the fee shall be born equally by the <br />parties. <br /> ARTICLE VI <br /> UTILITIES <br />Lessee sha 11 have the right to use the utility service facilities <br />located on The Premises at the commencement of the term of this <br />Agreement. In addition, should Lessee's operations or construction of <br />improvements require additional utility service facilities, Lessee <br />
