I <br /> " <br /> CERTIFICATE OF APPROVAL PURSUANT <br /> TO SECTION 103 (k) OF THE INTERNAL <br /> REVENUE CODE OF 1954, AS AMENDED <br />RE: Capital Area Housing Finance Corporation <br /> Multi-Family Housing Revenue Bonds, Series 1985 <br /> $6,600,000 for the benefit of San Marcos Ranch (a Texas joint <br />venture organized by R.C. Hoppe and Ken Rice) to provide fi nancing <br />for the acquisition, construction, equipping and completion of a <br />multi-family rental residential development (San Marcos Ranch <br />Development) consisting of approximately 228 units to be located <br />on 13 acres on Ranch Road 12, between San Marcos Academy and Old <br />San Marcos Academy, San Marcos, Hays County, Texas. <br /> I, Emmie Craddock, Mayor of the City of San Marcos, Hays <br />County, Texas, do hereby certify with respect to the $6,600,000 <br />Capital Area Housing Finance Corporation Multi-Family Housing <br />Revenue Bonds, Series 1985 (San Marcos Ranch Development), <br />hereafter the "Bonds", that: <br /> Solely for the purpose of satisfying the requirements of <br />Section 103 (k) of the Internal Revenue Code of 1954, as amended, <br />and for no other purpose, I hereby approve the Bonds. This <br />approval is not to be construed as (i) a representation or <br />warranty by City of San Marcos, Hays County, Texas, the Mayor of <br />the city of San Marcos, Hays County, the State of Texas or any <br />other agency, instrumentality or political subdivision of the <br />State of Texas that the Bonds will be paid or that any obligations <br />assumed by any of the parties under the instruments described <br />above will in fact be performed; (ii) as a pledge of the faith and <br />credit of or by the State of Texas or any agency, instrumentality <br />or political subdivision of the State; (iii) as a representation <br />or warranty concerning the validity of the corporate existence of <br />the issuer or the validity of the Bonds. This approval is <br />conditioned on the implementation of that agreement by R.C.
