Box 1306 Albuquerque, NM 87103 -1306 Agreement number: The City of San Marcos (the "City ") and the United States Fish and Wildlife Service- San Marcos Aquatic Resources Center ( "ARC ") collectively referred to as the "Parties" enter into this Memorandum of Agreement (the "Agreement ") for ARC's provision of professional services in connection with the propagation of Texas Wild Rice and other Native Plants (the "services ") RECITALS: WHEREAS, non - native aquatic plants such as hydrilla, hygrophila, and wild taro have become problematic in and along the San Marcos River, displacing and shading out native plants; and WHEREAS, two of the goals of the Edwards Aquifer Habitat Conservation Plan ( "EAHCP ") are the protection of species that are designated as threatened or endangered under state and federal laws and the enhancement and restoration of Texas Wild Rice ( "TWR ") and establishment of native plants (EAHCP 2011). WHEREAS, these restoration/propagation services are funded by the Edward's Aquifer Authority and can be performed by the ARC; and WHEREAS the City wishes to restore disturbed habitats in the San Marcos River and establish populations of TWR and other native aquatic, riparian, and terrestrial plants; and WHEREAS, it is in the interest of economy and efficiency, that the parties enter into a cooperative program; and NOW THEREFORE, in consideration of the mutual covenants and promises contained ARC Agreement 2014 -2019
