Box 1306 <br />Albuquerque, NM 87103 -1306 <br />Agreement number: <br />The City of San Marcos (the "City ") and the United States Fish and Wildlife Service- San <br />Marcos Aquatic Resources Center ( "ARC ") collectively referred to as the "Parties" enter into <br />this Memorandum of Agreement (the "Agreement ") for ARC's provision of professional <br />services in connection with the propagation of Texas Wild Rice and other Native Plants (the <br />"services ") <br />RECITALS: <br />WHEREAS, non - native aquatic plants such as hydrilla, hygrophila, and wild taro have <br />become problematic in and along the San Marcos River, displacing and shading out native <br />plants; and <br />WHEREAS, two of the goals of the Edwards Aquifer Habitat Conservation Plan <br />( "EAHCP ") are the protection of species that are designated as threatened or endangered under <br />state and federal laws and the enhancement and restoration of Texas Wild Rice ( "TWR ") and <br />establishment of native plants (EAHCP 2011). <br />WHEREAS, these restoration/propagation services are funded by the Edward's Aquifer <br />Authority and can be performed by the ARC; and <br />WHEREAS the City wishes to restore disturbed habitats in the San Marcos River and <br />establish populations of TWR and other native aquatic, riparian, and terrestrial plants; and <br />WHEREAS, it is in the interest of economy and efficiency, that the parties enter into a <br />cooperative program; and <br />NOW THEREFORE, in consideration of the mutual covenants and promises contained <br />ARC Agreement 2014 -2019 <br />
