b) May to August - Final production of up to 4,800 plants for restoration efforts on the San <br />Marcos River. <br />c) May to November — Monitoring the success /failure ratio of TWR and other native aquatic <br />plants planted for restoration efforts in the San Marcos River. Monitoring will occur at 1, <br />3, 6, and 9 months, and will culminate with the submission of a final report to the City no <br />later than December 31 for each year. <br />d) In the event restoration activities preclude the delivery of ARC produced plants the US <br />Fish and Wildlife Service will maintain plants for no longer than one month after 31 <br />December or one month following the termination of this Agreement. <br />B. City Agreements: <br />The City agrees to: <br />1) Designate Melani Howard, Habitat Conservation Plan Manager as the City's representative <br />in all matters related to this Agreement. <br />2) Pick up the plants from ARC whenever the City is ready to replant in the San Marcos River. <br />Section 3. Compensation <br />The City agrees to pay ARC a fixed fee of $65,477.00 for ARC's performance of its Services <br />under this Agreement in accordance with the requirements of the United States Fish and Wildlife <br />Service upon receipt of an invoice from the ARC no sooner than February 1, each year (2014 to <br />2019). The City will provide an advance payment annually of the sum above for reimbursable <br />work in the form of a check made payable to the U.S. Fish and Wildlife Service. Neither party to <br />this Agreement expects that there will be a need for the provision of additional services. The <br />City and ARC will negotiate the compensation for additional services in the event those services <br />become necessary.
