4.08. Management of the Project. The Rail District is the only Party with any <br />responsibility for managing or administering the Project or determining the schedule and <br />operations of transportation improvements. The City may inspect Project sites and review <br />Project plans and drawings at times and intervals, and comment on the Project. Each City shall <br />be given notice of adoption of Rail District budgets and provided access to the budgets. Prior to <br />the occurrence of either of the events listed in Section 6.04, the City shall manage the Zone. <br />After either event listed in Section 6.04 occurs, the Rail District shall manage the Zone. <br />4.09. Expansion of the Zone. The obligation of the City to participate in the Zone is <br />limited to the description of the Zone as created by this Agreement and attached as Exhibit "C" <br />to this Agreement. The City's participation shall not extend to the Tax Increment on any <br />additional property added to the Zone by the Rail District unless the City approves such <br />participation in writing, except for the adjustments of the Zone provided in Section 3.6. <br />4.10. In -Kind Contributions by the City. In addition to the Tax Increment Funds <br />provided herein, City shall provide for all stations served by the Rail District within the City <br />limits of the City's custodial services, maintenance of the station grounds and landscaping, and <br />expenses related to utilities (water, electric, wastewater and trash removal) and security. <br />Maintenance and other standards for these services shall be set out in separate agreements <br />between the City and Rail District. Unless otherwise established in this separate maintenance <br />agreement or other standards, the City shall provide in -kind services consistent with the City's <br />standards for its offices or other facilities with regular daily public access. <br />4.11. Redetermination of Pam. In the event, there is an additional calculation or <br />redetermination of payments by any Party providing the payments or the Rail District, the Party <br />providing payments shall have no obligation to make any additional payment if the <br />_10- <br />
