7.07. No Waiver of Immunity. No Party hereto waives or relinquishes any immunity or <br />defense on behalf of itself, its officers, employees, and agents as a result of its execution of this <br />Agreement and performance or non- performance of the covenants contained herein. <br />7.08. Access to Financial Information. The Rail District will prepare an annual report <br />regarding the Zone no later than 180 days from the end of the Rail District fiscal year, a copy of <br />which will be provided to all Parties. Furthermore, each Party to this Agreement shall have <br />reasonable access to financial information and audit reports regarding the operation of the Zone, <br />contribution of Tax Increment Payments to the Tax Increment Fund, and expenditures from the <br />Tax Increment Fund for Administrative Costs and Project Costs. In addition, the Rail District <br />agrees, during the term of this Agreement, to prepare and deliver an annual report to all Parties. <br />7.09 Long Term Funding Projection. No later than the six (6) months following the <br />completion of five (5) years of rail operations, the Rail District shall provide a Long Term <br />Funding Projection to the City which shall include at a minimum a twenty (20) year forecast of <br />operating and capital costs and a similar forecast five (5) years prior to the end of the initial term <br />of this Agreement. <br />7.10. Equity of Funding Effort. The Rail District agrees that interlocal agreements for <br />funding involving other entities will contain equitable funding for the service provided. As <br />other Central Texas cities and counties sign interlocal agreements, the City will be provided <br />copies of such interlocal agreements and will have an opportunity for a period of sixty (60) days <br />after the agreements are provided to the City to determine that provisions of an interlocal <br />agreement between the Rail District and another city are materially more favorable than the <br />provisions of this Agreement and to object in writing and request an amendment to this <br />Agreement to provide funding that is equitable in comparison to the service provided to another <br />
