RESOLUTION BY THE BOARD OF DIRECTORS <br />AUTHORIZING INTERLOCAL AGREEMENTS WITH LOCAL GOVERNMENT <br />MEMBERS FOR THE CREATION OF TRANSPORTATION INFRASTRUCTURE <br />ZONES <br />WHEREAS, the Texas Transportation Code, Section 173.256 authorizes the Lone Star Rail <br />District (Rail District) to enter into interlocal agreements with local governmental entities for the <br />financing of transportation infrastructure; and <br />WHEREAS, the Rail District has been engaged in negotiations with local governmental entities <br />to create interlocal agreements; and <br />WHEREAS, the City of San Marcos, Texas, a local government member of the Rail District, will <br />submit during December for Council approval an interlocal agreement providing for tax <br />increment funding for certain transportation infrastructure to be a part of the passenger rail plan <br />for the Rail District to be effective commencing in 2013 and has also agreed to consider certain <br />future amendments to the interlocal agreement; and <br />WHEREAS, other local government members are negotiating with the Rail District to enter into <br />similar interlocal agreements for the financing of transportation infrastructure; <br />NOW, BE IT THEREFORE RESOLVED, that the Chairman of the Board of Directors or the <br />Executive Director of the Rail District are authorized to execute and enter into an interlocal <br />agreement with the City of San Marcos, Texas, and are also authorized to enter into similar <br />interlocal agreements with other local government members. <br />Sid Covington, G4rman <br />Board of Directors <br />December 6, 2013 <br />P.O.
