4.04. Additional Tax Increment Payments. In addition to the Tax Increment Payment <br />provided to be made by the City in Section 4.03, the City shall make an additional payment into <br />the Tax Increment Fund on the dates provided for payments into the Tax Increment Fund equal <br />to one percent (1 %) of the amount of the one percent (1 %) sales tax revenue collected by each <br />the City within the Zone which amount exceeds the sales tax revenue collected by each the City <br />within the Zone for the year of the Tax Increment Base. The City Tax Increment Payment for <br />sales tax revenue may be increased by an amount up to fifty percent (50 %) of the amount of the <br />one percent (1 %) sales tax revenue collected by each the City within the Zone which amount <br />exceeds the sales tax revenue collected by each the City within the Zone for the year of the Tax <br />Increment Base by amendment to this Agreement agreed to by the Parties. The City agrees that <br />it will consider and make the decision on this amendment no later than July 1, 2014. The City <br />shall make the calculation of the payment to the Tax Increment Fund as provided in this Section <br />and provide a report of the calculations at the time payments are made. There shall be no refund <br />to the City of amounts paid under this Section, even if the City determines after making the <br />payment that its calculation was incorrect. <br />4.05. Delinquent Deposits and Other Revenue Sources. Any delinquent deposit of a <br />Tax Increment Payment under this Agreement by the City shall be administered as provided by <br />Rules and Regulations of the Rail District which follow in general terms the provisions of <br />Section 311.013(c) of the Texas Tax Code (or its successor provision). The Parties expressly <br />agree that the City shall not owe any penalty or interest on Tax Increments that have been levied, <br />but not received by the City. In addition, the City shall not be obligated to contribute its Tax <br />Increment Payment from any non -Tax Increment revenue sources. <br />
