Public Hearing <br />16.7:OOPM Receive a Staff presentation and hold a public hearing to receive comments for <br />or against Ordinance 2013 -69 creating Transportation Reinvestment Zone Number <br />One, City of San Marcos for the extension and expansion of FM 110; and consider <br />approval of Ordinance 2013 -69, on the first of two readings. <br />Steve Parker, Assistant City Manager and CFO, provided the Council with a brief presentation. <br />Following the presentation Mayor Guerrero opened the Public Hearing at 7:17 p.m. <br />There being no comments Mayor Guerrero closed the Public Hearing at 7:17 p.m. <br />MOTION: Upon a motion made by Council Member Thomaides and a second by Council <br />Member Scott, the City Council voted six (6) for, none (0) opposed, and one (1) abstention, <br />Council Member Prather, to approve Ordinance 2013 -69 on the first of two readings, as <br />previously captioned. The motion carried. <br />17. 7:OOPM Receive a Staff presentation and hold a Public Hearing to receive comments for <br />or against Ordinance 2013 -70 updating and amending Water and Wastewater Impact Fees <br />to be charged by the City of San Marcos by amending Chapter 86, Article 5, Division 4 - <br />Impact Fees, of the San Marcos City Code; adopting updated Land Use Assumptions and <br />an updated Capital Improvements Plan; amending the Impact Fee Service Area <br />Boundaries for these facilities; adopting the 2013 Update of the Water and Wastewater <br />Impact Fees Report; amending exemptions and exclusions from Impact Fees; and by <br />deleting Chapter 7, Article 7 - Impact Fees and Chapter 8 Definitions, Article 3 - Impact- <br />Fee definitions by deleting these sections in their entirety from the Land Development Code <br />to avoid duplication; providing for severability; providing for savings and repeal; including <br />procedural provisions; providing for penalties; and providing for an effective date; and <br />consider approval of Ordinance 2013 -70, on the first of two readings. <br />Kristy Stark, Assistant Director of Development Services and Tony Bagwell with HDR <br />Engineering provided the Council with a presentation regarding the Water and Wastewater <br />Impact Fees Report. <br />Following the presentation Mayor Guerrero opened the Public Hearing at 7:23 p.m. <br />Kevin Kutras, 804 Columbia Avenue, spoke on behalf of the San Marcos River Foundation and <br />spoke in favor of raising the impact fees to the maximum rate. He addressed the benefits that <br />will occur and that new development should be paying for itself. Please vote yes to <br />Robert McDonald, 3735 Lost Creek Blvd, Austin, TX, spoke against the raising of the impact <br />fees. He does not feel that we should do something that would discourage economic <br />development. He believes that the shortfall is the formula that is used to calculate the impact fee <br />
