<br />4 <br /> <br /> <br />'-C <br />ORDINANCE 1985-24 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING THAT <br />ORDINANCE 1984-70, ADOPTED JUNE 13, 1984 <br />DECLARING A BUILDING MORATORIUM FOR <br />MULTI-FAMILY DWELLINGS IN PLANNING UNITS <br />1, 2, 3, 4, 5, 52, 53, 18 AND 32, <br />LIMITING THE NUMBER OF L.U.E.'S ISSUED <br />FROM REMAINING SEWERAGE TREATMENT <br />CAPACITY, REQUIRING COMPLIANCE WITH THE <br />MASTER PLAN LAND USE ELEMENT, AND <br />ESTABLISHING A CITIZEN COMMITTEE TO <br />ADVISE COUNCIL ON PROBLEM SOLUTIONS TO <br />EXCEPT FROM THE REQUIREMENTS OF SUCH <br />ORDINANCE INSTITUTIONAL ADDITIONS IN THE <br />DESIGNATED PLANNING UNITS; AND DECLARING <br />AN EMERGENCY AND PROVIDING FOR AN <br />EFFECTIVE DATE. <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 1 of Ordinance 1984-70 <br />adopted June 13, 1984, is hereby deleted in its entirety and <br />a new Section 1 is added as follows: <br /> <br />That from the effective date of this Ordinance and <br />until further action by the City Council, no <br />building permits for other than single-family <br />residential construction be issued in planning <br />units 1, 2, 3, 4, 5, 52, 53, 18 and 32 as they are <br />designated in the City's Master Plan, except that <br />any rehabilitation, remodelling, construction <br />buildouts under existing building shells, or <br />institutional additions shall be permitted in each <br />of the planning units designated above. <br /> <br />SECTION 2. That the importance of this Ordinance to <br />the public welfare and for the public good creates an <br />emergency and an imperative public necessity so that the <br />provisions of the Charter requiring all ordinances to be <br />presented at three (3) separate meetings and that no <br />ordinance shall become effective until the expiration of ten <br />(10) days following the date of its final passage, be <br />suspended, and this Ordinance shall take effect and be in <br />full force and effect from and after its adoption and after <br />its publication in a newspaper of general circulation within <br />the City in accordance with the Charter of the City of San <br />Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this 27 day of February, <br />1985. <br /> <br /> <br />g::~- (]L"~,, - <br /> <br />Emmie Craddock <br />Mayor <br /> <br />Attest: <br /> <br /> <br />c11imAj( 2r ~~ <br /> <br />Janis K.
