<br /> 18 <br />-9 <br /> ORDINANCE 1985-26 <br />~ '5 <br />s::. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN I-1ARCOS, TEXAS AMENDING SECTION 5-17, IM- <br /> PROVEMENTS ON UNPLATTED PROPERTY, OF DIVISION <br /> 1 OF ARTICLE II OF CHAPTER 5 OF THE CODE OF <br /> ORDINANCES OF SAID ÇITY TO PROVIDE THAT ANY <br /> VARIANCE TO THE REQUIREMENT CONTAINED THEREIN <br /> MAY BE GRANTED ONLY BY THE PLANNING COMMISSION <br /> OR, ON APPEAL, BY THE CITY COUNCIL AS PROVIDED <br /> IN THE SUBDIVISION ORDINANCE, APPENDIX C, <br /> CODE OF ORDINANCES OF SAID CITY; AND DECLARI,NG <br /> AN EMERGENCY. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That Section 5-17 of Division 1 of Article <br /> II of Chapter 5 of the Code of Ordinances of the City of San <br /> Marcos, Texas is hereby amended to read as follows: <br /> Sec. 5-17. Improvements on unplatted property. <br /> No building permit shall be issued for improve- <br /> ments on unplatted property. Any variance to this <br /> requirement may be granted only by the Planning <br /> Commission or, on appeal, by the City Council, as <br /> provided in the Subdivision Ordinance, Appendix C, <br /> Code of Ordinances of the City of San Marcos, <br /> Texas. <br /> SECTION 2.
