<br /> 56 <br /> RESOLUTION 1985-30R <br /> A RE m LUTI ON OF THE CI'IY COUNCI L OF THE CI'IY OF <br /> SAN MARCOS, TEXAS, FINDING THAT CERTAIN PROFDSED <br /> BILIBOARD LEGISLATION IS NOT IN THE BEST INTEREST OF <br /> CITIZENS OF SAN MARCOS AND OPFDSING H.B. 1330 AND S.B. <br /> 897, AND DOCLARIN; AN EFFECTIVE DATE. <br /> WHEREAS, the citizens of Texas and the State legislature in 1913 <br /> voted to give citizens the right of self determination through the <br /> creation of home rule cities; and <br /> WHEREAS, cities around the state have exercised this authority in <br /> a judicious and careful manner since being granted that au thori ty ; <br /> and, <br /> WHEREAS, cities have used this authority to respond to citizen <br /> concerns for regula tion of billboards for the health and safety of <br /> their conmmity through the passage of ordinances which establish <br /> billboard standards and require nonconforming billboards to be removed <br /> after completion of an equitable amortization period; and, <br /> WHEREAS, the ability of cities to utilize amortization as a means <br /> of b illl:)()ard regulation has been upheld numerous times in state and <br /> federal court; and, <br /> WHEREAS, the billboard industry is proposing legislation which <br /> would eliminate the use of amortization by requiring cash payments <br /> prior to the removal of nonconforming billboards; now, therefore, <br /> BE IT REmLVED BY 'IRE CI'IY CDUNCIL OF THE CI'IY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. Tha t the proposed billboard legislation is not in the <br /> best interest of the c i ti zens of S:m Marcos, Texas because of the <br /> threat it poses to the doctrine of local self determination. <br /> PART 2. That the legislature of the State of Texas be asked to <br /> oppose H.B. 1330 and S.B. 897. <br /> PART 3. That the Mayor of the City of San Marcos, Etnmie Craddock, <br /> is authorized and requested to forward ccpies of this Resolution to the <br /> State representatives from this area and take any further and <br /> additional action in support of this Resolution that she may deem <br /> necessary. <br /> PART 4.
