79 ORDINANCE 1985-38 ...cJ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ADDING SECTION 13-24 TO ARTICLE II OF CHAPTER 13 OF THE CODE OF ORDINANCES OF SAID CITY PROVIDING FOR TEMPORARY EMERGENCY TERMINATION OF WATER SERVICE i PROVIDING FOR A REVIEW OF AN EMERGENCY ORDER TO TERMINATE WATER SERVICE i PROVIDING FOR APPEALS TO THE CITY COUNCIL FROM DECISIONS OF THE CITY HEALTH AUTHORITY ABOUT TERMINATION OF WATER SERVICE; AND, DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 13-24 be added to Article II of Chapter 13 of the Code of Ordinances of the City of San Marcos, Texas, as follows: Sec. 13-24. Emergency termination of water supply. The City Health Authority of the City of San Marcos shall have the power to requlre the temporary termination of water service at any place in the City of San Marcos if the Authority determines an event is creating or will cause extensive or severe property damage or is imposing an immediate or serious threat to human safety or health (hereafter called lithe unsanitary condi tion"), and the temporary cessation of water service will prevent the threat to property, safety, or health from becoming worse. The order may be issued without notice and review and administered as practicable and reasonable under the circumstances. If an emergency order to terminate the water supply is issued under this authority without notice and review, the issuing authority shall fix a time and place for a review conference. Notice of review conference shall be given the owner or agent of the owner in a manner calculated to give notice as soon as possible, and a review conference shall be held within 72 hours of the emergency termination. The purpose of the review conference will be to explain the purpose of the termination of the water service and to instruct the owner or agent of the owner what steps are necessary to correct the unsanitary condition. If, after the conference, the unsanitary condition is corrected, the water service shall be immediately restored. Appeals of the decisions of the City Health Authority are to be made to the City Council and are to be in writing and filed with the City Secretary. The appeal will be heard by the City Council as soon as possible, but in no case later than five (5) days from the date of filing. SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its passage and after is publication in a newspaper of general circulation in the area.
