<br /> 79 <br /> ORDINANCE 1985-38 <br /> ...cJ <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, ADDING <br /> SECTION 13-24 TO ARTICLE II OF CHAPTER 13 <br /> OF THE CODE OF ORDINANCES OF SAID CITY <br /> PROVIDING FOR TEMPORARY EMERGENCY <br /> TERMINATION OF WATER SERVICE i PROVIDING <br /> FOR A REVIEW OF AN EMERGENCY ORDER TO <br /> TERMINATE WATER SERVICE i PROVIDING FOR <br /> APPEALS TO THE CITY COUNCIL FROM <br /> DECISIONS OF THE CITY HEALTH AUTHORITY <br /> ABOUT TERMINATION OF WATER SERVICE; AND, <br /> DECLARING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That Section 13-24 be added to Article II <br /> of Chapter 13 of the Code of Ordinances of the City of San <br /> Marcos, Texas, as follows: <br /> Sec. 13-24. Emergency termination of water supply. <br /> The City Health Authority of the City of San Marcos <br /> shall have the power to requlre the temporary <br /> termination of water service at any place in the City of <br /> San Marcos if the Authority determines an event is <br /> creating or will cause extensive or severe property <br /> damage or is imposing an immediate or serious threat to <br /> human safety or health (hereafter called lithe unsanitary <br /> condi tion"), and the temporary cessation of water <br /> service will prevent the threat to property, safety, or <br /> health from becoming worse. The order may be issued <br /> without notice and review and administered as <br /> practicable and reasonable under the circumstances. <br /> If an emergency order to terminate the water supply is <br /> issued under this authority without notice and review, <br /> the issuing authority shall fix a time and place for a <br /> review conference. <br /> Notice of review conference shall be given the owner or <br /> agent of the owner in a manner calculated to give notice <br /> as soon as possible, and a review conference shall be <br /> held within 72 hours of the emergency termination. The <br /> purpose of the review conference will be to explain the <br /> purpose of the termination of the water service and to <br /> instruct the owner or agent of the owner what steps are <br /> necessary to correct the unsanitary condition. <br /> If, after the conference, the unsanitary condition is <br /> corrected, the water service shall be immediately <br /> restored. <br /> Appeals of the decisions of the City Health Authority <br /> are to be made to the City Council and are to be in <br /> writing and filed with the City Secretary. The appeal <br /> will be heard by the City Council as soon as possible, <br /> but in no case later than five (5) days from the date of <br /> filing. <br /> SECTION 2. That this Ordinance shall be in effect <br /> ten (10) days from and after its passage and after is <br /> publication in a newspaper of general circulation in the <br /> area. <br />
