<br /> 81 <br /> ...c:» ORDINANCE 1985...40 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, MAKING IT <br /> UNLAWFUL TO RECEIVE OR ASSIST IN <br /> RECEIVING UNAUTHORIZED CABLE SERVICE; <br /> ESTABLISHING A RANGE FOR FINES FOR <br /> VIOLATION OF THIS ORDINANCE; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That the following Ordinance shall be <br /> added to Chapter 16 of the Code of Ordinances of the City of <br /> San Marcos, Texas as Section 16-13 which shall read as <br /> follows: <br /> Sec. 16-13. Unauthorized reception of cab1e <br /> servlce. <br /> (a) It shall be unlawful for any person to <br /> intercept or receive or assist in <br /> intercepting or receiving any communications <br /> service offered over a cable system unless <br /> specifically authorized to do so by a cable <br /> operator or as may otherwise be specifically <br /> authorized by law. <br /> (b) Definitions <br /> (1) The phrase "assist in in te rc epti ng or <br /> receiving II shall include the manufacture <br /> or distribution of equipment intended by <br /> the manufacturer or distributor for <br /> unauthorized reception of any <br /> communications serV1.ce offered over a <br /> cable system. <br /> ( 2) The phrase "cable operator" mea ns any <br /> person or group of persons <br /> a. ) who prov ide ( s) cable service over a <br /> cable system and directly or <br /> through one or more affiliates owns <br /> a significant interest in a cable <br /> system, or <br /> b.) who otherwise controls or is <br /> responsible for, through any <br /> arrangement, the management and <br /> operation of a cable system. <br /> (3) The phrase "cable system" means a <br /> facility consisting of a set of closed <br /> transmission paths and associated signal <br /> genera tion, reception, and control <br /> equipment that is designed to provide <br /> cable service which includes video <br /> programming and which is provided to <br /> multiple subscribers within a community. <br /> The phrase II cable system" does not <br /> include: <br /> a.) a facility that serves only to <br /> retransmi t the television signals <br /> of one or more television broadcast <br /> stations, or <br />
