{ 0 For purposes of this section, the date indicated by a U.S. Post <br />Office postmark on an envelope mailed to the city at its correct address, containing a <br />report or payment due under this section, is considered the date of receipt by the <br />city. <br />Sec. 78.104. Access to records. <br />Caj Each person who owns, operates, manages or controls a hotel shall <br />allow access to all books and records necessary to verify the accuracy of any <br />report filed as required by this article, upon reasonable notice by the city. <br />Every hotel within the City limits shall keep and maintain accurate <br />records of the consideration and hotel occupancy tax paid by the occupant of the <br />sleeping room in the hotel. Such records shall include, but not be limited to, at a <br />minimum, guest folios, tax exemption certificates, and any original documents <br />such as posting ledgers and rate and stay djustment reports. These records may <br />be retained in any retrievable format and shall be maintained for a period of not <br />less than four (4) years. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 4.
