Capital improvement means either a water facility or a wastewater facility, with a life expectancy <br />of three or more years, to be owned and operated by or on behalf of the city. <br />Capital improvements plan means the adopted plan, as amended from time to time, that identifies <br />water and wastewater capital improvements or facility expansions and their associated costs <br />which are necessitated by and attributable to new development and will be financed in whole or <br />in part through water or wastewater impact fees imposed under this division. The capital <br />improvements plan includes the wastewater improvements plan and the water improvements <br />plan. <br />City means the City of San Marcos, Texas. <br />Credit means the amount of the reduction of an impact fee for fees, payments or charges for the <br />same type of capital improvements for which the fee has been assessed. <br />Director means the Public Services Director or Department Director designated by the City <br />Manager. <br />Department means the Public Services Department or Department designated by the City <br />Manager Facility expansion means an expansion of the capacity of any existing water or <br />wastewater facility, as applicable, for the purpose of serving new development, but does not <br />include the repair, maintenance, modernization, or expansion of an existing water or wastewater <br />facility to the extent that it serves existing development. <br />Impact fee means a fee either for water facilities or for wastewater facilities imposed on new <br />development in order to generate revenue to fund or recoup all or part of the costs of capital <br />improvements or facility expansions necessitated by and attributable to the new development. <br />Impact fees do not include: 1) the dedication of rights -of -way or easements for water facilities or <br />wastewater facilities, 2) a requirement for the construction of such facilities imposed under the <br />city's zoning or subdivision regulations, 3) fees placed in trust funds for the purpose of <br />reimbursing developers for oversizing or constructing water or wastewater mains, 4) pro rata fees <br />for reimbursement of the city's costs for extending water or wastewater mains, or 5) charges for <br />water or wastewater services to a wholesale customer such as a water district, political <br />subdivision of the state, or other wholesale utility customer. <br />Land use assumptions means the projections of population and employment growth and <br />associated changes in land uses, densities and intensities and other planning information adopted <br />by the city, as amended from time to time, upon which the capital improvements plan is based. <br />New development means an activity involving the construction, reconstruction, redevelopment, <br />conversion, structural alteration, relocation, or enlargement of any structure, or any use or <br />extension of land, which 1) has the effect of increasing the requirements for capital <br />improvements or facility expansions, measured by the number of service units to be generated by <br />the activity, 2) requires the approval of a plat, the issuance of a building permit, or connection to <br />the city's water or wastewater system, and 3) is not exempted from impact fees by the provisions <br />of this division. New development includes the conversion of an existing use from on -site water <br />or wastewater facilities to the use of city water or wastewater facilities. <br />11 <br />
