117 ORDINANCE 1985-51 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE PROJECT PLAN AND FINANCING PLAN OF REINVESTMENT ZONE NUMBER ONE, CITY OF SAN MARCOS, TEXAS; PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, , created Reinvestment Zone Number One, City of San , Texas (the "Zone"), by Ordinance No. 1983-80 (the Ordinance") pursuant to the Texas Tax Increment Financing of 1981, as amended, codified as Article 1066e, Vernon's Texas Civil Statutes (the "Act"); and, WHEREAS, the City Council established a Board of Directors for the Zone which the Ordinance required to make recommendations to the City Council co nee rni ng the administration of the Zone and to prepare or cause to be prepared and adopted a project plan and financing plan for the Zone; and, WHEREAS, the Board of Directors has adopted such project plan and financing plan for the Zone on February 20, 1985, and submitted them to the City Council for approval; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the facts and recitations co ntai ned in the preamble of this Ordinance are hereby found and declared to be true and correct. SECTION 2. That the City has made the following findings and determinations based on the evidence and testimony presented to it: (a) that the Project Plan and Financing Plan for the Zone dated February 6, 1985, are feasible; and (b) that the Project Plan and Financing Plan for the Zone dated February 6, 1985, conform to the master plan of the City. SECTION 3. That the City hereby approves the Project Plan and Financing Plan for the Zone dated February 6, 1985, a copy of which shall remain on file in the office of the City Secretary. Approval of the Project Plan and Financing Plan constitutes authorization and approval of the PUblic Improvements Construction and Financing Agreement attached as Exhibit C to the Plans; the Mayor is hereby authorized to execute said Public Improvements Construction and Financing Agreement and any instrument related to its implementation. SECTION 4. That if any section, paragraph, clause or provision of this Ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceabilityof such section, paragraph, clause or provision shall not affect any of the remaining provisions of the Ordinance. SECTION 5. That it is hereby found, determined and declared that a sufficient written notice of the date, hour, place and subject of the meeting of the City Council at which this Ordinance was adopted was posted at a place convenient and readily accessible at all times to the general public at the City Hall of the City for the time required by law preceding this meeting, as per the Open Meetings Law, Article 6252-17, Vernon 's Texas Civil Statutes, as amended, and that this meeting has been open to the public as required by law at all times during which this Ordinance and the subject matter hereof has been discussed, considered and formally acted upon.
