Of?/Œ PUBLIC IMPROVEMENT CONSTRUCTION AND FINANCING AGREEMENT BETWEEN CITY OF SAN MARCOS, TEXAS AND FINANCIAL MANAGEMENT GROUP, a partnership comprised of Heinz Schwaderlapp, Maria Schwaderlapp, Michael Schwaderlapp, Julia Schwaderlapp, Petra Schwaderlapp and Hubert Hubinger THE STATE OF TEXAS § § COUNTY OF HAYS § Agreement is entered into as of the Ie day of , 1985, by and between the City of San Marcos, Texas, a home rule city located in Hays County, Texas (the "City") , and Financial Management Group, a partnership comprised of Heinz Schwaderlapp, Maria Schwaderlapp, Michael Schwaderlapp, Julia Schwaderlapp, Petra Schwaderlapp and Hubert Hubinger (the "Developer"). RECITALS The Developer is the owner of approxim~tely 121.43 acres of land more particularly described by metes and bounds in Exhibit A at- tached hereto and made a part hereof. All of said land is within the present boundaries of the City, and the City has designated such property as Reinvestment Zone No. 1, City of San Marcos, Texas (the "Reinvestment Zone"), in accordance with the Texas Tax Increment Financing Act of 1981, as amended (Article 1066e, Vernon's Texas Civil Statutes). With the assistance of the Developer, a project plan (the "Plan") for the Reinvestment Zone has been prepared, and the Plan has been approved by the Board of Directors of the Reinvestment Zone (the "Board of Directors") and the City Council of the City. The Plan describes certain public improvements including Transportation Improvements, Wastewater Improvements, Water Improvements, Drainage Improvements, Utili- ties Improvements, and Site Improvements (referred to herein as the "Facilities," and collectively as the "Project") required for
