Of?/Œ <br />PUBLIC IMPROVEMENT CONSTRUCTION AND FINANCING AGREEMENT <br /> BETWEEN <br /> CITY OF SAN MARCOS, TEXAS <br /> AND <br /> FINANCIAL MANAGEMENT GROUP, <br /> a partnership comprised of <br /> Heinz Schwaderlapp, Maria Schwaderlapp, <br /> Michael Schwaderlapp, Julia Schwaderlapp, <br /> Petra Schwaderlapp and Hubert Hubinger <br />THE STATE OF TEXAS § <br /> § <br />COUNTY OF HAYS § <br />Agreement is entered into as of the Ie day of <br /> , 1985, by and between the City of San Marcos, <br />Texas, a home rule city located in Hays County, Texas (the <br />"City") , and Financial Management Group, a partnership comprised <br />of Heinz Schwaderlapp, Maria Schwaderlapp, Michael Schwaderlapp, <br />Julia Schwaderlapp, Petra Schwaderlapp and Hubert Hubinger (the <br />"Developer"). <br /> RECITALS <br />The Developer is the owner of approxim~tely 121.43 acres of land <br />more particularly described by metes and bounds in Exhibit A at- <br />tached hereto and made a part hereof. All of said land is within <br />the present boundaries of the City, and the City has designated <br />such property as Reinvestment Zone No. 1, City of San Marcos, <br />Texas (the "Reinvestment Zone"), in accordance with the Texas Tax <br />Increment Financing Act of 1981, as amended (Article 1066e, <br />Vernon's Texas Civil Statutes). With the assistance of the <br />Developer, a project plan (the "Plan") for the Reinvestment Zone <br />has been prepared, and the Plan has been approved by the Board of <br />Directors of the Reinvestment Zone (the "Board of Directors") and <br />the City Council of the City. The Plan describes certain public <br />improvements including Transportation Improvements, Wastewater <br />Improvements, Water Improvements, Drainage Improvements, Utili- <br />ties Improvements, and Site Improvements (referred to herein as <br />the "Facilities," and collectively as the "Project") required for <br />
