<br /> A RESOLUTION OF THE CITY COUNCIL OF THE
<br /> CITY OF SAN MARCOS, TEXAS, APPROVING THE
<br /> GRANTING OF AN INGRESS AND EGRESS
<br /> EASEMENT BY SAID CITY TO VICO INVESTMENTS
<br /> JOINT VENTURE IN, ON AND ACROSS 0.055
<br /> ACRES OF LAND, MORE OR LESS, IN THE J.M.
<br /> VERAMENDI SURVEY NO. 2; AUTHORIZING THE
<br /> MAYOR TO EXECUTE SAID EASEMENT; AND,
<br /> DECLARING AN EFFECTIVE DATE.
<br /> ~'¡HEREAS, Vico Real Estate Company, a Panamanian
<br /> corporation has granted to the City of San Marcos, Texas a
<br /> drainage easement and temporary construction easement on,
<br /> over and across a parcel of land containing 0.015 acres in
<br /> the J.M. Veramendi League No. 2; and,
<br /> WHEREAS, the City Council of the City of San Marcos,
<br /> Texas, desires to grant an easement for the purposes of
<br /> ingress and egress, on, over and across an 0.055 acre tract
<br /> of land, more or less, more particularly described
<br /> hereinbelow, to Vico Investments Joint Venture, a joint
<br /> venture composed of Vico Real Estate Company, a Panamanian
<br /> corporation, and S. Gary Rob erts; now, therefore,
<br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS:
<br /> PART 1. That the granting of an easement for the
<br /> purposes of ingress and egress by said City on, over and
<br /> across the following describ ed property located in Hays
<br /> County, Texas:
<br /> DESCRIPTION OF A SURVEY MADE ON THE GROUND AND
<br /> PREPARED FROM PUBLIC RECORDS OF 0.055 ACRES OF
<br /> LAND, MORE OR LESS, IN THE J.M. VERAMENDI SURVEY
<br /> NO. 2, SAN MARCOS, HAYS COUNTY, TEXAS, BEING A
<br /> PORTION OF THAT TRACT DESCRIBED AS 0.75 ACRES IN A
<br /> DEED FROM JAMES TUTTLE TO THE CITY OF SAN MARCOS,
<br /> DATED OCTOBER 16, 1967 AND RECORDED IN VOLUME 220,
<br /> PAGE 225 OF THE HAYS COUNTY DEED RECORDS, AND
<br /> BEING MORE PARTICULARLY DESCRIBED BY METES AND
<br /> BOUNDS AS FOLLOWS:
<br /> BEGINNING at an 1/2" iron rod set for the and the
<br /> east corner of this tract, being the north corner
<br /> of that tract described as 3.78 acres (trac t one)
<br /> in a deed from Louis Mecey to Vico Real Estate
<br /> Company, dated April 29, 1977 and recorded in
<br /> Volume 295, Page 476 of the Hays County Deed
<br /> Records, same being the east corner of the City of
<br /> San Marcos 0.75 acre tract, in the south line of
<br /> that tract described as 2.975 acres in a deed from
<br /> Serafy and Williamson Joint Venture to Jay
<br /> Williamson and N.T. Serafy, individually, dated
<br /> January 4, 1984 and recorded in Volume 412, Page
<br /> 500 of the Hays County Deed Records;
<br /> THENCE, leaving the PLACE OF BEGINNING as shown on
<br /> that plat numbered 20918-82-a as revised March 15,
<br /> 1985 for Gary Roberts by Byrn and Associates,
<br /> Inc., of San Marcos, Texas, and the Williamson and
<br /> Serafy 2.975 acre tract with the common line of
<br /> the Vico Real Estate Company 3.78 acre tract and
<br /> the City of San Marcos 0.75 acre tract S43°49IOO"W
<br /> 44.20 feet to the south corner of this tract, from
<br /> which corner a chain link fence corner post for
<br /> reference S24°001l4"E 0.27 feet;
