44 ORDINANCE 1985-59 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 35.H.3.g. OF THE GENERAL ZONING ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, BY ADDING A SUBSECTION (2) TO SAID SECTION 35.H.3.g PERTAINING TO THE ACQUISITION OF SPECIFIC USE PERMITS FOR ESTABLISHMENTS WHICH ARE LICENSED FOR ON-PREMISE CONSUMPTION OF LIQUOR; AND, DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 35.H.3.g. of the General Zoning Ordinance of the Code of Ordinances of the City of San Marcos, Texas, be amended to add a subsection (2) to read as follows: . . . (2) The Planning Director shall issue a specific use permit to any establishment, which is in conformance with this Code, and, for which a currently valid TABC license for on-premise consumption of liquor was issued before December 27, 1984. It shall be the responsibility of a TABC license holder to acquire a specific use permit. Establishments which acquire specific use permits under this subsection (2) shall comply with all pertinent provisions of this Code, except subsection a. of Section 35.H.3. SECTION 2. That this Ordinance shall be in effect ten (lO) days from and after its passage and after its publication in a newspaper of general circulation in the area.
