<br /> 64 <br /> ORDINANCE 1985-61 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, AMENDING <br /> SECTION 1 OF ORDINANCE 1984-100 ADOPTED <br /> NOVEMBER 5, 1984 WHICH DECLARED A <br /> BUILDING MORATORIUM FOR 120 DAYS ON <br /> DEVELOPMENTAL APPROVALS, INCLUDING <br /> APPROVAL OF ZONING CHANGES, PLATS, AND <br /> BUILDING PERMITS, ON ALL LAND AREA <br /> LOCATED WITHIN THE ONE HUNDRED (100) YEAR <br /> FLOODPLAIN OF SAN MARCOS RIVER TO EXTEND <br /> SAID MORATORIUM THROUGH AUGUST 2, 1985; <br /> AND DECLARING AN EMERGENCY. <br /> WHEREAS, the City Council of the City of San Marcos, <br /> Texas, has determined that the environmental integrity of <br /> the San Marcos River ecosystem will be adversely impacted <br /> from development if the building moratorium declared by <br /> Ordinance 1984-100 is not extended; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SEC'rION 1. That Section 1 of Ordinance 1984-100 <br /> adopted on November 5, 1984 declaring a building <br /> moratorium for 120 days on developmental approvals, <br /> including approval of zoning changes, plats, and building <br /> permits, on all land area located within the one hundred <br /> (100) year floodplain of the San Marcos River from Spring <br /> Lake to the confluence of the Blanco and San Marcos Rivers <br /> is hereby amended to read as follows: <br /> SECTION 1. That from and after the <br /> effective date of this Ordinance no <br /> developmental approvals shall be made by said <br /> City, including approval of zoning changes, <br /> plats, and building permits, on any land area <br /> located within the one hundred (100) year <br /> floodplain of the San Marcos River with all Soil <br /> Conservation Service dam projects in place, as <br /> shown in the Watershed Plan and Environmental <br /> Impact Statement, <br /> USDA-SCS-EIS-WS-(ADM}-78-2(f}-(TX}, from Spring <br /> Lake to the confluence of the Blanco and San <br /> Marcos Rivers, through August 2, 1985 or after <br /> the adoption of an Interim Comprehensive <br /> Development Ordinance, whichever is sooner, the <br /> purpose of such ordinance being to protect the <br /> environmental integrity of the San Marcos River <br /> ecosystem from adverse impact resulting from <br /> development in the above-defined area. <br /> SECTION 2. The the importance of this Ordinance to <br /> the public welfare and for the public good creates an <br /> emergency and an imperative public necessity so that the <br /> provisions of the Charter requiring that ordinances shall <br /> be presented at three separate meetings and that no <br /> ordinance shall become effective until the expiration of <br /> ten (10) days following the date of its final passage be <br /> suspended,and these provision are hereby suspended, and <br /> this Ordinance shall take effect and be in full force and <br /> effect from and after its adoption and after its <br /> publication in a newspaper of general circulation in the <br /> area as required by the Charter of the City of San Marcos, <br /> Texas. <br /> PASSED, APPROVED AND ADOPTED this 10 day of June , <br /> 1985. <br /> Mayor <br />
