<br />66 <br /> <br /> <br />ORDINANCE 1985-63 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF 'mE CITY OF SAN <br />MARCOS, TEXAS, REPEALING ORDINANCE 1985-4 AOOPTED <br />JANUARY 14, 1985, AND AMENDIt\G SErTION 3 OF THAT <br />ORDINANCE WHICH RmJIATES AND RESTRICTS THE LOCATION <br />AND USE OF BUIIDII\GS, STRUCTIJRES AND LAND, DATED JUNE <br />13, 1984 (VOL. 66), BY ZONING LOT 1 OF THE PIAT OF LOT <br />1, roST ROAD RETAIL ADDITION, AS SHCWN ON THE MAP OR PLAT <br />THEREOF RECORDED IN VOLUME 3, PAGE 268, PIAT RECORDS OF <br />HAYS COUNTY, TEXAS, A/K/A/ 1700 OID roST ROAD FROM "PD" <br />(PRE-DEVELOPMENT DISTRICT) TO "c" (COMMERCIAL DISTRICT) <br />FOR THE EAST HALF OF SAID LOT 1 AND 'ill "c" <br />(COMMERCIAL DISTRICT) FOR THE WEST HALF OF SAID <br />LOT 1 WHICH, UPON ITS ANNEXATION 'ill SAID CITY ON JUNE <br />25, 1957 vvAS UNZONED ; AMENDING THE FUTIJRE LAND USE <br />PLAN (MAP) OF THE MASTER PLAN OF SAID CITY AND DECLARING <br />AN EFFErTIVE DATE. <br /> <br /> <br />VVHEREAS, on June 19, 1984 the Joint Planning and Zoning <br />Commissions of the City of San Marcos, Texas, considered a request for <br />a change in the land use of a tract consisting of 0.82 acres, more or <br />less, of land area in the J.M. Veramendi League, Survey No.2, City of <br />San Marcos, Hays County, Texas, and being that tract conveyed from <br />James W. Gary, et ux, to Humble oil and Refining Company by deed dated <br />January 4,1929, as recorded in Volume 97, Page 454 of the Hays County <br />Deed Records; and, <br /> <br />WHEREAS, on June 5,1984, the Zoning Commission of the City of San <br />Marcos, Texas considered a request for a change in zoning of said tract <br />of land; and, <br /> <br />WHEREAS, subsequent to the approval and recomrændations by said <br />Commissions for said change in land use and zoning as requested, 0.072 <br />acres of said original 0.82 acres was dedicated to the public on the <br />Plat Of Lot 1, Ibst Road Retail Mdition, of record in Volume 3, Page <br />268, Plat Records of Hays County, Texas; and, <br /> <br />WHEREAS, the r~naining 0.748 acres of said original 0.82 acre was <br />platted as Lot 1 on that Plat Of Lot 1, Ibst Road Retail Mdition, of <br />record in Volume 3, Page 268, Plat Records of Hays County, Texas; now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Ordinance 1985-4 adopted on January 14, 1985 1S <br />hereby repealed. <br /> <br />SErTION 2. That the following tract of real property located in <br />San Marcos, Hays County, Texas, which was classified "PD" (Pre-Develop- <br />ment District) upon its annexation to the City of San Marcos, on <br />May 26, 1981 (East Half), and which was unzoned upon its <br />annexation to said City on June 25,1957 (west Half), henceforth shall <br />be zoned as "c" (Cormœrcial District). <br /> <br />Lot 1, Plat Of fDt 1, Fbst Road Retail Addition, as shown on <br />the map or plat thereof recorded in Volume 3, Page 268, Plat <br />Records of Hays County, Texas. <br /> <br /> <br />SErTION 3. That the tract of property described in Section 2 <br />above which is in an area shown on the Future Land Use Plan (Map) of <br />the Master Plan of the City of San Marcos as Industrial henceforth <br />shall be shown on said Map as Cormœrcial. <br /> <br />SECTION 4. That this Ordinance shall be in effect ten (10) days <br />from and after its passage and it shall be published in a newspaper <br />of general circulation in the area as required by the Charter of the <br />Ci ty of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading May 6, 1985. <br /> <br /> <br />PASSED AND APPROVED on second read ing May 20, 1985. <br /> <br />PASSED, APPROVED AND AOOPTED June 10, 1985. <br />
