69 RESOLUTION 1985-49R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING EXECUTION OF A RELEASE AND SATISFACTION OF JUDGMENT AND ANY AND ALL OTHER DOCUMENTS PERTINENT TO HAYS COUNTY DISTRICT COURT CASE NUMBER 12,640, STYLED CITY OF SAN MARCOS, TEXAS VS. SHAUN KELLEY AND JOHN H. KELLEY; ACCEP'rING AN AGREEMEN'1~, COMPROMISE AND SETTLEMENT IN SAID CASE IN THE AMOUNT OF $9,225.39; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos was awarded a judgment in the case of the City of San Marcos vs. Shaun Kelley and John H. Kelley in the amount of $7,720.75 plus interest; and, WHEREAS, Shaun Kelley and John H. Kelley have tendered a check in the amount of $9,225.39 to the City of San Marcos in compromise, settlement and satisfaction of that judgment; and, WHEREAS, it is appropriate to execute a Release And Satisfaction Of Judgment when the judgment as agreed upon by the parties has been paid in full; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the Release And Satisfaction Of Judgment in Cause Number 12,640, City of San Marcos v. Shaun Kelley, et aI, a copy of said judgment being attached hereto and incorporated herein for all purposes, is hereby in all things approved. PART 2. That the check in the amount of $9,225.39 is accepted as payment in full of that judgment. PART 3. That the Mayor, Emmie Craddock, be, and she is hereby, authorized to execute the Release And Satisfaction Of Judgment and any and all other documents pertinent to Case Number 12,640 on behalf of said City. PART 4. That thi s Resolution shall be in full force and effect from and after its passage. ADOPTED this 10 day of June , 1985. Mayor Attest: Janis K. Womack City Secretary
