94 RESOLUTION 1985~55R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, TERMINATING THAT CERTAIN CONTRACT BETWEEN COMMUNITY LAND RESOURCES, INC. AND SAID CITY DATED MAY 21, 1985; APPROVING THE TERMS AND CONDITIONS OF A PROPOSED CONTRACT WITH KENT S. BUTLER AND LEWIS F. MCLAIN FOR THE PROVISION TO SAID CITY OF PLANNING AND MANAGEMENT SERVICES IN CONNECTION WITH THE REVIEW AND NEGOTIATION OF MUNICIPAL UTILITY DISTRICT PROPOSALS; AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACT AND ANY AND ALL OTHER DOCUMENTS AND INSTRUMENTS INCIDENT TO THE PURPOSES OF SAID CONTRACT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, by resolution adopted on May 20, 1985, the City of San Marcos, Texas, entered into a contract with Community Land Resources, Inc. on May 21, 1985 for the provision to said City of planning and management services in connection with the review and negotiation of municipal utility district proposals; and, WHEREAS, the City Council of said City finds that it is in the interest and welfare of the citizens of San Marcos, Texas, to terminate such contract with Community Land Resources, Inc. and to enter into a contract with Kent S. Butler and Lewis F. McLain for the provision to said City of such services; and, WHEREAS, the City Council of said City hereby finds that the proposed contract with Kent S. Butler and Lewis F. McLain will result in the provision of additional services to said City than those provided for in the Community Land Resources, Inc. contract; and, WHEREAS, by letter dated June 4, 1985, said Community Land Resources, Inc. has agreed to the termination of such contract with said City; and, WHEREAS, the City Council of the City of San Marcos, Texas, desires to obtain the planning and management services of Kent S. Butler and Lewis F. McLain in connection with the review and negotiation of municipal utility district proposals; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That that certain contract between Community Land Resources, Inc. and said City, executed by said City on May 21, 1985, be, and it is hereby, terminated. PART 2. That the terms and conditions of a proposed contract between said City and Kent s. Butler and Lewis F. McLain for the provision to said City of planning and management services in connection with the review and negotiation of municipal utility district proposals, a copy of said proposed contract being attached hereto and incorporated herein for all purposes, are hereby in all things approved. PART 3. That the City Manager, A.C. Gonzalez, be, and he is hereby, authorized to execute said contract and any and all other documents and instruments incident to the purposes of said contract on behalf of said City.
