<br /> ORDINANCE 1985-71 106 <br /> AN ORDINANCE OF THE CI'rY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, AMENDING <br /> CHAPTER 21 OF THE SAN MARCOS CODE OF <br /> ORDINANCES BY REPEALING THE CURRENT <br /> SECTION 21-39 COMPENSATION; ADDING A NEW <br /> SECTION 21-39 WHICH PROVIDES FOR NEW <br /> RATES FOR SPECIAL ASSIGNMENT SERVICES; <br /> ADDING A PROVISION FOR PROSECUTION FOR <br /> NONPAYMENT OF FEES; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> SECTION 1. That Section 21-39 of the San Marcos <br />Code of Ordinances shall be repealed. <br /> SECTION 2. That Section 21-39 of the San Marcos <br />Code of Ordinances shall be adopted to read as follows: <br /> Sec. 21-39. Compensation. <br /> The City shall charge a fee for these Services <br /> in the amount of $24.00 per Police Officer per <br /> hour. The City will pay the Police Officers <br /> $18.00 per hour each. The City will use $6.00 <br /> per hour to cover administrative benefit costs. <br /> The contractor will deposit the required fee <br /> with the Finance Department of the City at least <br /> 14 days prior to the date of the function for <br /> which services are requested. If the request <br /> for Services is cancelled three (3) or more days <br /> before the function, the City will refund the <br /> fee. If the request for services is cancelled <br /> less than three (3) days before the function the <br /> City will retain the fee and pay the officer <br /> $18.00 per hour for the Services they would have <br /> performed had the function not been cancelled. <br /> The Chief of Police will not approve any request <br /> for less than two (2) officer hours. The time <br /> periods established by this seciton may be <br /> waived for good cause at the discretion of the <br /> Chief of Police. <br /> Failure to pay fees for Services shall be a <br /> Class C misdemeanor. Each day the fees are not <br /> paid after 10 days notice that the fees are due <br /> has been sent by the City shall constitute a <br /> separate offense. Any fines collected from <br /> prosecution of a violation of this ordinance <br /> shall be paid in addition to payment of fees for <br /> Services. <br /> SECTION 3.
