<br /> -2- <br /> within any floodway, as defined in <br /> Chapter 5 of this Code; within one <br /> hundred (100) feet of the centerline <br /> of the Blanco River, and within fifty <br /> (50) feet of the centerline of any <br /> tributary of the Blanco or San Marcos <br /> Rivers, as defined on the United <br /> states Geological Survey 7.5 minute <br /> quadrangle maps. <br /> (2) Exceptions to this may include road <br /> and utility rights-of-way or <br /> easements meeting the floodplain <br /> utilization standards of the City of <br /> San Marcos and as approved by the <br /> Director of Environment and <br /> Engineering. <br /> SECTION 3. That Section 14 1/2-5 of Chapter 14 1/2 of <br /> the Code of Ordinances of the City of San Marcos, Texas, is <br /> hereby amended to add thereto subsections (e), (e) (1), (e) (2), <br /> (e) (3), ( f), (f)(l), (f)(2), (f)(3), (g), (g) (1) and (h) which <br /> shall read as follows: <br /> Sec. 14 1/2-5. General requirements. <br /> . . . <br /> (e) Construction phase. <br /> (1) No paving with concrete, asphalt, or <br /> other impervious material within tree <br /> crown zone (drip line zone) of trees <br /> to be preserved shall be allowed. <br /> (2) Soil and other materials shall not be <br /> temporarily or permanently stored in <br /> locations which would cause <br /> suffocation of root systems of trees <br /> to be preserved. <br /> ( 3) The permanent vegetation shall be <br /> installed on the construction site as <br /> soon as utilities are in place and <br /> final grades are achieved. Final <br /> grading and removal of vegetation <br /> shall not occur more than 30 days <br /> prior to scheduled paving. <br /> ( f) Removal of diseased or dangerous trees and <br /> vegetation: <br /> (1) Upon direction from the Director of <br /> Environment and Engineering, property <br /> owners may be required to treat or <br /> remove trees suffering from <br /> transmittable diseases or pests or <br /> allow the City to do so, charging the <br /> actual cost thereof to the property <br /> owner. <br /> (2) The Director of Environment and <br /> Engineering may require the removal <br /> of a tree or part of a tree or any <br /> other vegetation that may be: (a) in <br /> danger of falling and injuring <br /> persons or damaging property off the <br /> owner's property; (b) within or <br /> overhanging a public right-of-way or <br /> easement; and/or (c) creating a <br /> traffic hazard or sight distance <br /> hazard for traffic on a public <br /> street. <br />
