<br /> 4 <br /> ORDINANCE 1985-79 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE <br /> CITY OF SAN ~RCOS, TEXAS, ADDING CHAPTER <br /> 36 ENTITLED SAN MARCOS RIVER CORRIDOR TO <br /> THE CODE OF ORDINANCES OF SAID CITY; <br /> DECLARING THE PURPOSE OF THIS LEGISLATION <br /> TO BE REMEDIAL; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City of San Marcos is charged with <br /> protecting the health, safety, and welfare of its citizens¡ <br /> and, <br /> WHEREAS, the following addition of Chapter 36 to the <br /> Code of Ordinances of the City of San Marcos, Texas, is for <br /> the purpose of the advancement of the public welfare and <br /> conducive to the public good¡ and, <br /> WHEREAS, these new provisions in Chapter 36 correct <br /> defects or mistakes in existing laws, supply regulations <br /> omitted in former law, and provide for changes in the mode of <br /> procedure relating to development in the San Marcos River <br /> Corridor¡ and, <br /> WHEREAS, the city of San Marcos is committed to the <br /> protection of the San Marcos River, its banks, its environs, <br /> and other environmentally sensitive areas associated with it¡ <br /> and, <br /> WHEREAS, the City of San Marcos wants to make these <br /> additions and changes to the Code of Ordinances as a whole <br /> remedial¡ now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> ~RCOS, TEXAS: <br /> SECTION 1. That the following Chapter 36 be added to <br /> and become a part of the Code of Ordinances of the City of <br /> San Marcos, Texas: <br /> Sec. 1. Findings and objectives. <br /> A. Findings. <br /> 1. The City of San Marcos is the trustee of <br /> the natural environment of the San Marcos <br /> River for existing and future generations <br /> of citizens of the City and its environs¡ <br /> and <br /> 2. The San Marcos River provides significant <br /> and irreplaceable recreational <br /> opportunities to the citizens of the City <br /> and its environs¡ and <br /> 3. The San Marcos River ecosystem is <br /> biologically unique, some species found <br /> in the first few kilometers of the San <br /> Marcos River are found nowhere else; and <br /> 4. Development that is insensitively <br /> planned, improperly constructed, or <br /> poorly maintained near the San Marcos <br /> Ri ver can resul-t in irreparable damage to <br /> the natural environment and, <br /> particularly, to the quality of the water <br /> in the San Marcos River; and <br />
