<br />44 <br /> <br />Regular Meeting <br /> <br />October 27, 1986 <br /> <br />Page 4 <br /> <br />clutter the Zoning Ordinance, as it is not directly related to zoning. <br />Mr. Hankins stated the Council could consider splitting the Ordinance <br />and having Appendixes H and I or whatever portion the Council wants <br />in the Zoning Ordinance could be prepared with the Council's direction. <br />Ms. Wickersham stated it could be added to the site plan for curb cuts. <br />Mr. Robbins stated it probably best belongs in the Building Code and <br />that he could work with Steve Jenkins and Patsy Greiner on this. Mr. <br />Farr requested Messrs. Robbins and Jenkins look into the possibility of <br />a split of the Ordinance and it was consensus of Council for them to re- <br />view this possibility. On roll call for approval of the Ordinance on <br />first reading, the following vote was recorded: <br /> <br />AYE: <br /> <br />Farr, Guerra, Kissler. <br /> <br />NAY: <br /> <br />Coddington, Younger. <br /> <br />The motion failed. <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance on <br />second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 30 OP THE SAN MARCOS <br />CODE OF ORDINANANCES TO INCLUDE ARTICLE III, DIVISION <br />I TO BE ENTITLED IIINDUSTRIAL WASTE ORDINANCEII, REGULAT- <br />ING THE DISCHARGE OF INDUSTRIAL WASTE INTO THE SANITARY <br />SEWERAGE SYSTEM AND THE STORM DRAINAGE SYSTEM OF THE <br />CITY OF SAN MARCOS BY DEFINING TERMS, REQUIRING STRUCTURES, <br />PROVIDING FOR PERMITS FOR DISCHARGING INDUSTRIAL WASTE INTO <br />A PUBLIC SEWER OR WATERCOURSE, AUTHORIZING DISCONNECTION <br />OF WATER AND/OR SANITARY SEWER SERVICE TO PERSONS VIOLATING <br />THIS ORDINANCE, PROVIDING FOR INSPECTION AND SAMPLING OF <br />INDUSTRIAL WASTE DISCHARGES, PROHIBITING THE DISCHARGE OF <br />CERTAIN WASTES INTO PUBLIC SEWERS OR WATERCOURSES, REQUIR- <br />ING PRETREATMENT OF CERTAIN INDUSTRIAL WASTES, PROVIDING <br />A SURCHARGE FOR NORMAL SEWAGE, AUTHORIZING THE DIRECTOR <br />OF ENVIRONMENT AND ENGINEERING TO DETERMINE THE SUFFICIENCY <br />OF PRETREATMENT; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR <br />ORDINANCES AND PROVISIONS OF SAN MARCOS IN CONFLICT WITH IT; <br />PROVIDING REMEDIES; PROVIDING PENALTIES; PROVIDING FOR SE- <br />PARABILITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Farr moved for approval of the Ordinance on second reading and Mayor <br />Younger seconded the motion. Mr. Guerra asked Mr. Je~kins where monitoring <br />begins, and Mr. Jenkins stated as close to the property line as can get <br />(if there is any physical obstruction). Bill Haney reviewed with Council <br />suggested changes to the Ordinance, a copy of which is attached to these <br />minutes. Mr. Jenkins requested Mr. Haney come by and work out the <br />changes before third reading. On roll call, the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Parr, Younger, Guerra, Kissler. <br /> <br />NAY: <br /> <br />Coddington. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Mayor Younger introduced for consideration approval of two Ordinances <br />on second reading and adoption of two Ordinances on third and final <br />reading by consensus. Mayor Younger requested Item l4(B) (1) be pulled <br />for separate discussion. Mr. Guerra moved to approve the two Ordinances <br />on second reading and the remaining Ordinance on third and final reading <br />by consensus and Ms. Kissler seconded the motion, which passed unani- <br />mously (with Mr. Coddington voting NAY on Item l4(A) (1)).
