<br /> 87 <br /> ORDINANCE 1985-92 <br /> AN ORDIN.ANCE OF THE CI'rY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, AMENDING <br /> CHAPTER 12 GARBAGE AND RUBBISH OF THE <br /> CODE OF ORDINANCES OF SAID CITY BY MAKING <br /> BILLING FOR GARBAGE AND RUBBISH <br /> COLLECTION MANDATORY; PROVIDING A <br /> REQUIREMENT FOR DOCUMENTING COLLECTION <br /> CONTRACTS; AND DECLARING AN EFFECTIVE <br /> DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> SECTION 1. That Chapter 12, Section 12-8(c) of the <br />Code of Ordinances of City of San Marcos be amended to read <br />as follows: <br /> . . . <br /> ( c) Charges for garbage and rubbish collection <br /> services at. residential units described in §12-8(a) <br /> are mandatory and shall be billed to the person to <br /> whom water services are billed. I f the residential <br /> unit does not receive a monthly water bill, charges <br /> for garbage and rubbish collection shall be billed <br /> to the owner of the residential unit unless other <br /> arrangements are made between the City, the City's <br /> contractor and the owner of the property for the <br /> assumption of responsibility for garbage and <br /> rubbish collection charges. The City shall render <br /> bills monthly. <br /> . .. <br /> SECTION 2. That Chapter 12, Section 12-9 of the Code <br />of Ordinances of the City of San Marcos be amended to read as <br />follows: <br /> Sec. 12-9. Residential units served by a bin. <br /> Residential units served by a bin shall be exempt <br /> from the requirements of Sections 12-3, 12-4, <br /> 12-5, and 12-8 after the owners have provided the <br /> City with proof that they have contracted with a <br /> collector other than the City for removal of <br /> garbage and rubbish for the period for which they <br /> are requesting the exemption. <br /> SECTION 3. That this Ordinance shall be in effect <br />ten (10) days from and after its passage, and it shall be <br />published in a newspaper of general circulation in the area <br />as required by the Charter of the City of San Marcos, Texas. <br /> PASSED AND APPROVED on rst reading August 26, 1985. <br /> PASSED AND APPROVED on second reading September 9, 1985. <br /> PASSED, APPROVED AND ADOPTED September 23, 1985. <br /> Emmie Craddock <br /> Mayor <br />
