<br />88 <br /> <br />...... <br />~ ORDINANCE 1985-93 <br /><;...D <br /> <br />~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 10, FIRE PREVENTION <br />AND PROTECTION OF 'IRE CODE OF ORDINANCES OF 'IRE CITY <br />OF SAN MARCOS BY DELETING SECTION 10-18 AND SECTION <br />10-42(b) yVHICH DEAL WI'IR THEAProIN'IMENT, QUALIFICATIONS <br />AND REMOVAL OF A CITY FIRE MARSHAL AND SUBSTITUTING NEW <br />SECTIONS FOR 'IROSE DELETED, DELETING A roRTION OF SECTION <br />10-42(c) CONCERNING FIRE INSPECIORS AND CLARIFYING ITS <br />PROVISIONS AND DECLARING AN EFFECTIVE DATE. <br /> <br /> <br />\iVHEREAS, the City Council of the City of San Marcos, Texas, finds <br />that there are conflicts between Sections 10-18 and 10-42(b) of the <br />Fire Prevention and Protection Code of the City of San Marcos dealing <br />wi th the appointment, quali fications, and removal of a City Fire <br />Marshal; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, wishes <br />to clarify the responsibilities for appointment and removal of the City <br />Fire Marshal; therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF TI-lE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 10-18, Appointment, Qualifications And <br />Removal, of Article II, Fire Marshal, of the Fire Prevention and <br />Protection Code, Chapter lO, of the Code of Ordinances of the City of <br />San Marcos, Texas, is hereby deleted in its entirety and the following <br />substituted therefor. <br /> <br />Sec. 10-18. Appointment, Qualifications and RemovaL <br /> <br />The Fire Marshal shall be appointed by the City Manager <br />or his designee on the basis of examination to determine his <br />qualifications for the duties of his office. The Fire Marshal <br />shall be an unclassified employee subject to all of the <br />applicable provisions of the Personnel Bolicies of the City of <br />San ~1arcos as they now exist or as they may be amended. <br /> <br /> <br />SECTION 2. That Section 10-42, Establishment and Duties of Bureau <br />of Fire Prevention, Subsection (b) of the Fire Prevention and <br />Protection Code, Chapter 10 of the Code of Ordinances of the City of <br />San Marcos, Texas, be deleted in its entirety and the following <br />substituted therefor. <br /> <br /> <br />Sec. 10-42. Establishment and Duties of Bureau of Fire <br />Prevention. <br /> <br /> <br />. . . <br /> <br /> <br />(b) The Fire Marshal in charge of the Bureau of Fire <br />Prevention shall be appointed by the City Manager or his <br />designee on the basis of examination to determine his <br />qualifications. The Fire Marshal shall be subject to <br />the applicable provisions of the Personnel Bolicies of <br />the City of San Marcos as they now exist or as they may <br />be amended. <br /> <br /> <br />SECTION 3. That Section 10-42, Establishment and Duties of Bureau <br />of Fire Prevention, Subsection (c) of the Fire Prevention and <br />Protection Code, Chapter 10 of the Code of Ordinances of the City of <br />San Marcos, Texas, be amended by deleting the last sentence and adding <br />clarifying language so that it provides as follows. <br /> <br />Sec. 10-42.
