-2- provision of similar services or benefit.s, Flight Operations shall maintain and operate such facilities and services in compliance with all other n~quirements imposed pursuant to 49 CFR Part 21, Nondiscrimination in Federally Assisted Programs of the Department of Transportation, and as said, Regulations may be amended. III-A. Flight Operations for it, its successors in interest and assigns, as part: of the consideration hereof, does hereby covenant and agree as a covenant running with the land that: ( 1) no person on the grounds of race, color, or national origin shall be excluded from participation in, denied the benefits of, or be otherwise subjected to discrimination in the use of said facilities, (2) that in the construction of any improvements on, over, or under such land and the furnishing of services ,thereon, no person on the grounds of race, color, or national origin shall be excluded from participation in, denied the benefits of, or otherwise subjected to discrimination, ( 3) that Flight Operations shall use the premises in compliance with all other requirements imposed by or pursuant to 49 CFR Part 21, Nondiscrimination in Federally Assisted prograrns of the Department of Transportation, and as said Regulations may be amended. This agreement is subject to the right of the United States of America to have exclusive or non-exclusive use, control, and possession without charge of said Airport or any portion thereof during periods of national emergencyi and further subject to the right of the Federal Aviation Administration and the United States of America to take a portion of said Airport for air traffic control activities, weather reporting acti vi i:ies or communication activities related to air traffic control, all as provided in said indenture.
