<br /> -2- <br /> provision of similar services or benefit.s, Flight Operations <br /> shall maintain and operate such facilities and services in <br /> compliance with all other n~quirements imposed pursuant to 49 <br /> CFR Part 21, Nondiscrimination in Federally Assisted Programs <br /> of the Department of Transportation, and as said, Regulations <br /> may be amended. <br /> III-A. <br /> Flight Operations for it, its successors in interest and <br /> assigns, as part: of the consideration hereof, does hereby <br /> covenant and agree as a covenant running with the land that: <br /> ( 1) no person on the grounds of race, color, or national <br /> origin shall be excluded from participation in, denied the <br /> benefits of, or be otherwise subjected to discrimination in <br /> the use of said facilities, (2) that in the construction of <br /> any improvements on, over, or under such land and the <br /> furnishing of services ,thereon, no person on the grounds of <br /> race, color, or national origin shall be excluded from <br /> participation in, denied the benefits of, or otherwise <br /> subjected to discrimination, ( 3) that Flight Operations shall <br /> use the premises in compliance with all other requirements <br /> imposed by or pursuant to 49 CFR Part 21, Nondiscrimination <br /> in Federally Assisted prograrns of the Department of <br /> Transportation, and as said Regulations may be amended. <br /> VI. <br /> This agreement is subject to the right of the United <br /> States of America to have exclusive or non-exclusive use, <br /> control, and possession without charge of said Airport or any <br /> portion thereof during periods of national emergencyi and <br /> further subject to the right of the Federal Aviation <br /> Administration and the United States of America to take a <br /> portion of said Airport for air traffic control activities, <br /> weather reporting acti vi i:ies or communication activities <br /> related to air traffic control, all as provided in said <br /> indenture. This lease shall be subordinate to the provisions <br /> of any existing or future agreement between City and the <br />
