<br /> 69 <br /> RESOLUTION 1985-l02R <br /> A RESJLUTION OF THE CITY COUNCIL OF WE CITY OF SAN <br /> MARCOS, TEXAS, OPBJSING THE PLACEMENT OF AN OIL PIPELINE <br /> ACROSS THE EDWARDS AQUIFER RECHARGE ZONE; AND DIRECTING <br /> THE CITY MANAGER 10 FORWARD THIS REffiLUTION 'ill THE TEXAS <br /> RAILROAD COMMISSION, THE HAYS COUNTY COMMISSIONERS COURT, <br /> THE TEXAS WATER QUALITY BJARD AND THE ELWARDS UNDERGROUND <br /> WATER DISTRICT; AND DECLARIN3 AN EFFErTIVE DATE. <br /> WHEREAS, the City of San Marcos is committed to the protection of <br /> the Edwards Aquifer; and, <br /> \'llih'REAS, the Edwards Aquifer is the sole source of the water <br /> supply for the City of San Marcos and the surrounding area; and, <br /> \'lliEREAS, the actual effects of the oil pipeline proposed to cross <br /> the Edwards Ajuifer Recharge Zone are unknown at this time; and, <br /> WHEREAS, there is a potential for pollution of the Edwards Aquifer <br /> by the proposed oil pipeline, thereby endangering the sole source of <br /> water supply for the City of San Marcos; therefore, <br /> BE IT REffiLVED BY THE CITY Œ)UNCIL OF THE CI'IY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the City Council of the City of San Marcos, Texas, <br /> opposes the oil pipeline until such time as sufficient information is <br /> made available and verified to show that every possible protection of <br /> the Edwards Aquifer has been taken to assure that it will not be <br /> polluted by the installation and operation of the proposed oil <br /> pipeline. <br /> Pl\RT 2. That the Texas Railroad CoTIIDLLssion and the Texas Water <br /> Ouality Board are urgedto prevent the installation of the proposed oil <br /> pipeline over the Edwards Aquifer Recharge Zone until such time as <br /> adequate information is developed that assures that there is no <br /> unreasonable environmental risk to the Edwards Aquifer posed by said <br /> pipeline. <br /> PART 3. That the City Manager of the City of San Marcos shall <br /> provide copies of this Resolution to the Hays County Commissioners <br /> Court, The Edwards Underground Water District, The Texas Railroad <br /> Commission and the Texas Water Quality Board as soon as possible after <br /> its passage. <br /> PART 4.
