<br /> exclusively to the name, location, products, persons, accommcx1ations, <br /> services, sale, lease, construction, or activities of or on those <br /> premises where it is erected. <br /> SECTION 3. VARIANCES: <br /> a. Off-premise outdoor advertising signs existing on the date <br /> of this Ordinance may be continued and maintained in good <br /> condition, but shall not be replaced or structurally altered to <br /> prolong the life of the sign unless such replacement or alteration <br /> is first approved by the City Council as a variance to this <br /> Ordinance. A variance may be approved only for replacement <br /> or alteration of off-premise outdoor advertising signs which are <br /> to have the same loca tion and orientation as the <br /> existing/previous sign, which are to be no taller, wider, or <br /> larger than the existing/previous sign, which do not obstruct a <br /> scenic view as determined by the City Council, and for which a <br /> permit was granted by the Texas State Department of Highways <br /> and Public Transportation prior to July 29, 1985, if applicable. <br /> b. Those persons reques ting variances under these provisions <br /> must present their requests in writing to the City Secretary at <br /> least ten days prior to any Council meeting where the request will <br /> be considered. Each request must be accompanied by a copy of the <br /> required State permit, a location map, and a sketch indicating the <br /> siting and orientation of the existing/previous sign, the siting <br /> and orientation of the proposed replacement sign, the height and <br /> width of the proposed replacement sign and the height of the <br /> support structure for the proposed replacement sign, indicating <br /> the location of the proposed sign on the support structure. <br /> Section 4. That the im¡;x:>rtance of this Ordinance crea tes an <br /> emergency and an imperative public necessity to preserve the scenic <br /> beauty of San Marcos and protect the welfare of its citizens so that <br /> the provisions of the Charter requiring that ordinances shall be <br /> presented at three separate meetings and that no ordinance shall become <br /> effective until the expiration of ten days following the date of its <br /> final passage be suspended and these provisions are hereby suspended, <br /> and this Ordinance shall take effect and be in full force and effect <br /> from and after its adoption and it shall be published in a newspaper of <br /> general circulation within the City as provided in the City Charter. <br /> PASSED, APPROVED AND ADOPTED this 28 day of October ,1985. <br /> ~ Q <br /> Emmie Craddock <br /> Mayor <br /> ~~~~ <br /> Ci ty Secretary ' <br /> ~ <br /> ar W.
