<br /> 74 <br /> STATE TEXAS <br /> WATERSHED Upper San Marcos River <br /> CONTRACT NO. 68-7442-6-3399 <br /> UNITED STATES DEPARTMENT OF AGRICULTURE <br /> SOIL CONSERVATION SERVICE <br /> AGREEMENT FOR SERVICE <br /> THIS AGREEMENT made this 22 day of November , 19 85 by and <br /> between the City of San Marcos, hereinafter referred to as the City~nd the <br /> Soil Conservation Service, an agency of the Department of Agriculture, <br /> hereinafter referred to as the Service. <br /> WITNESSETH THAT: <br /> WHEREAS, under the provisions of the Flood Control Act of 1944, the <br /> City and the Service agreed to a work plan on the above watershed, which in <br /> part provides for the construction of a basic recreational facility along <br /> the San Marcos River. <br /> NOW THEREFORE, the City and the Service, in consideration of their <br /> mutual promises to each other hereinafter set forth, herein agree as follows: <br /> A. It is agreed that the following described engineering services are to <br /> be prepared by a private engineering firm at an estimated cost of <br /> $20,000.00: <br /> Construction plans and specifications for the recreational facilities. <br /> B. The City will: <br /> 1. Provide 50 percent of the cost of engineering services described <br /> in A. This cost is estimated to be $10,000.00. Upon receipt of a <br /> bill make payment to the Service for the City's share of the cost <br /> of the works of improvement. <br /> Payment must be received within 30 calendar days from the date of <br /> the bill, otherwise, it will be considered a late payment. For <br /> such late payments, interest will be accrued on the unpaid amount <br /> at a percentage rate based on the current value of funds to the <br /> U.S. Treasury for each 30 day period or portion thereof that the <br /> payment is delayed. Payments made by wire will be accepted and <br /> credited on the date received by the designated collection officer. <br /> 2. Accept all financial and other responsibility for excess costs <br /> resulting from their failure to obtain, or their delay in obtain- <br /> ing adequate land and water rights, permits and licenses needed <br /> for the engineering services described in A. <br /> 3. Designate an individual to serve as liaison between the City and <br /> the Service with authority and responsibility for reviewing and <br /> approving changes in the work described in A. Furnish such <br /> information in writing to the State Administrative Officer. <br />
