<br /> -2- <br /> ( 3) At the time of entering into an agreement to <br /> provide any cable service or other service to a subscriber and <br /> at least once a year thereafter, a cable operator shall <br /> provide notice in the form of a separate, written statement to <br /> such subscriber which clearly and conspicuously informs the <br /> subscriber of: <br /> A. the nature of personally identifiable <br /> information collected or to be collected with respect to the <br /> subscriber and the nature of the use of such information; <br /> B. the nature, frequency and purpose of any <br /> disclosure which may be made of such information, including an <br /> identification of the types of persons to whom the disclosure <br /> may be made; <br /> C. the period during which such information <br /> will be maintained by the cable operator; and, <br /> D. the times and place at which the <br /> subscriber may have access to such information. <br /> SECTION 3. Section 13 of Ordinance 1972-6 is amended <br /> to read as follows: <br /> . .. <br /> 13. <br /> Payment of Franchise Fee to City <br /> Within thirty (30) days following the close of each <br /> contract year, Company shall pay to the City a sum equal to <br /> four percent (4%) of the gross amount taken in and received by <br /> said Company from its monthly service revenue during such <br /> contract year, or a cash sum of Two Thousand and Five Hundred <br /> Dollars ($2,500.00), whichever is greater, but not to exceed <br /> five percent (5%) of the Company's gross revenues derived in <br /> the contract year from the operation of the cable system. <br /> SECTION 4.
