105 ORDINANCE 1985-115 i--. ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE IX SAN MARCOS SUNSET ADVISORY COMMISSION OF CHAPTER 2 OF THE SAN MARCOS CODE OF ORDINANCES BY ADDING GOALS FOR 'rI-IE COMMISSION, PROVIDING FOR ITS ACTIVATION EVERY THREE YEARS; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 2-136, Article IX, Chapter 2 of the San Marcos Code of Ordinances is repealed. SECTION 2. That new Section 2-136 is adopted to read as follows: The Sunset Advisory Commission shall be composed of seven (7) citizens of the City of San Marcos, appointed by the City Council. commissioners shall be appointed every three years beginning in January 1988 for terms not to exceed 12 months. The Commissioners shall at their first meeting, within 30 days after their appointment, elect a chair and vice-chair. The Commission may elect from its membership such other officers and committees as it may, from time to time, determine necessary for the proper performance of its duties. SECTION 3. That Section 2-137, Article IX, Chapter 2 of the San Marcos Code of Ordinances lS repealed. SECTION 4. That new Section 2-137 is adopted to read as follows: The Sunset Advisory Commission shall adopt such rules and regulations as it deems best to govern its actions subject to the laws of the State of Texas and of this City. The rules and regulations shall be such that the following goals can be attained: 1. to interview each member of each city board or commission 2. to attend two meetings of each board or commission 3. to interview each board or commission staff liaison person or persons. The Commission shall meet not less than once a month. At all meetings, the majority of the commission shall constitute a quorum and the concurrence of a majority of those present shall be required for the determination of matters within its jurisdiction. SECTION 5. That Section 2-141 is hereby adopted: Sec. 2-141. Dissolution of the sunset advisory COßUlllSSlon. Each Sunset Advisory Commission shall be automatically dissolved when it presents its report to the City Council and the report is formally received and accepted by the Council. The Sunset Advisory Commission that reported to the City Council in 1985 is hereby dissolved. SECTION 6. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
