individual, governmental authority or political subdivision for the operation and maintenance of any water, wastewater or other facilities which are within the power of the District to construct, operate or maintain. ARTICLE XI I I SEVERABILITY AND ENFORCEABILITY The provisions of this Agreement are severable and, in the event any word, phrase, clause, sentence, paragraph, section or other provision of this Agreement, or the application thereof to any person or circumstance, shall ever be held or determined by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, the remainder of this Agreement shall remain in full force and effect and the application thereof to any other person or circumstance shall not be affected thereby. The invalid, illegal or unenforceable provision shall be reviewed and rewritten, to accomplish the parties' original intent as nearly as possible. In the event that the Texas Water Commission determines that any provision of this Agreement is beyond the scope of the Texas Water Code, the City, Storm Development and the District agree to immediately amend this Agreement to conform to such ruling or decision and to accomplish the parties' original intent as nearly as possible. ARTICLE XIV BENEF I TS OF AGREEMENT This Agreement is for the benefit of the City, the District, and Storm Development, its successors and assigns, and shall not be construed to confer any benefit on any other party except as expressly provided herein. In furtherance of and to accomplish the purposes and objectives of the orderly development of the District and the City's North Service Area, regionalization of services, and economy and efficiency in providing municipal services to the District and the City's North Service Are a, the parties hereto agree to cooperate with each other and to coordinate their activities involving the Texas Water Commission and other parties, both public and private, in obtaining approval for the creation and operation of the District in accordance with the terms and provi sions of thi s Agreement.
