13 ORDINANCE 1985-118 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, GRANTING THE mNSENT OF THE CITY OF SAN MARCOS 10 THE CREATION OF A MUNICIPAL UTILITY DISTRICT: SAN MARCOS MUNICIPAL UTILITY DISTRICT NO. 2 SUBJEX::T 10 VARIOUS TERMS AND CONDITIONS SET FORTH IN A SEPARATE AGREEMENT MADE A PART OF THIS ORDINANCE; SUSPENDING THE RULE RE(JUIRING THE READlI'JG OF ORDINANCES ON THREE (3) SEPARATE DAYS; AND DEX::LARING AN EMERGENCY. vlliEREAS, pursuant to Section 54.016 of the Texas ~ater Code, the City Council of the City of San Marcos, Texas, (hereinafter the "City") has Ordinance No. 1984-107 (the "Ordinance") establishing a City policy on the creation of water stricts within the extraterritorial jurisdiction of the City; and, vlliEREAS, a petition for the consent of the City to the creation of a municipal utility district to be known as San Marcos Municipal Utility District No. 2 (the "District") to include the land 1n Attachment "I", has been with the City, and all of land is within the extraterritorial jurisdiction of the City; and, vlliEREAS, the Council of the City has evaluated the petition for consent to the of the accordance wi th the policy set forth 1n the Ordinance and deterroined that the proposed District substantially conforms to the policy except for those matters specifical]y addressed in the agreement; and, WHEREAS, certain proposed documents and agreements pertaining to this matter have been prepared by the District's proponents th participation by the City's staff and have been reviewed the City Council; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SEX::TION 1. That the terms and conditions of a proposed agreement granting the consent of the City Council to the creation of San Marcos Municipal Utility District No.2 between said City and the owners and developers of the property to be included in the proposed district, a copy of said proposed agreement being attached hereto and incorporated herein for all purposes as Attachment No.1, are hereby in all things approved. SEX::TION 2. That the Mayor, Emmie Craddock, be, and she hereby, authorized to execute said agreement enumerated in I above, and any and all documents and instruments incident thereto. SEX::TION 3. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after adoption and after its publication 1n a newspaper of general circulation within the City.
