<br /> the appropriate approvals for creation of a transportation <br /> corporation and/or a road district or districts to provide <br /> funding for all or a portion of the roadway improvements in <br /> accordance with the provisions of state law regarding said <br /> corporation or road districts. <br /> ( 3) Storm Development shall deposit with the appropriate <br /> governmental agency an irrevocable letter of credit in the amount <br /> of one million dollars ($1,000,000) in the aggregate with respect <br /> to the roadway needs for the land in this District and the San <br /> Marcos Municipal Utility District No. 1 at the time plans are <br /> approved for construction to be utilized to pay construction <br /> costs or construction-related costs for the Blanco River Bridge <br /> at 1-35 and the 1-35 interchange at the proposed parkway and to <br /> be drawn on by such agency at such time as the construction <br /> contract for the parkway from Interstate 35 to Ranch Road 12 is <br /> awarded. <br /> H. When a written transit agreement is executed by the <br /> City and/or Southwest Texas State University and the property <br /> owners' association within the District, Storm Development agrees <br /> to provide bus stop sites as required by the agreement in order <br /> to facilitate transportation within the District and surrounding <br /> areas. Storm Development agrees to donate a five acre site as <br /> shown on the Land Plan of the San Marcos Municipal Utility <br /> District No. 1 for a rail transit station for a rail transit <br /> system between the City of Austin, Texas and the City of San <br /> Antonio, Texas, at such time as said station may be required for <br /> completion of the transi t system. <br /> 1. Storm Development and the City shall each contribute an <br /> equal cash contribution of $10,000 in the aggregate per year for <br /> five years from the date the first industry locates within the <br /> boundaries of this District and the San Marcos Municipal Utility <br /> District No. 1, which contribution shall be made to any industry <br /> or industries located within the Districts and shall be for the <br /> purpose of establishing or maintaining an employee training <br /> program for existing San Marcos residents. This commitment to <br /> contribute said sums shall be contingent upon acceptance of the <br /> contribution by said industries. The division of the $10,000 <br /> among various industries within the Districts shall be determined <br /> by mutual agreement of Storm Development and the City based upon <br /> plans presented by the individual industries for such training <br /> programs. <br /> J. Storm Development agrees to participate in an <br /> affordable housing plan for low income families which the City <br /> may develop which shall be applicable generally within San Marcos <br /> in the future by ordinance, as amended from time to time. <br /> K. Storm Development, the City and the District <br /> acknowledge and agree that it is in the best interest of the <br /> residents and inhabitants of the District to obtain the level of <br /> fire protection services in the District that will provide to the <br /> property in the District the fire insurance benefits of the <br /> City's key rating by the State Board of Insurance. The parties <br /> further acknowledge that fire protection service provided by the <br /> City to the District and other areas in the region would <br /> accomplish that objective. Accordingly, the City agrees to <br /> ccoperate with the District in developing a method for the City <br /> to provide or assist in providing fire protection services in the <br /> District pursuant to the provisions of the Texas Water Code and <br /> the Interlocal Cooperation Act, Art. 4413 (32c), V.T.C.S. The <br /> District agrees to seek authorization to contract with the City <br /> for the City to provide or assist in providing fire protection <br /> services in the District and to initiate proceedings to obtain <br /> such authorization as soon as possible after creation of the <br /> District is approved by the Texas Water Commission. The parties <br /> agree that pending the development of the plan between the <br /> District and the City for the property in the District, such <br /> services may be provided on an interim basis by another enti ty. <br /> A:SMMUD1.4-15 (1/22/86) <br />
