the appropriate approvals for creation of a transportation corporation and/or a road district or districts to provide funding for all or a portion of the roadway improvements in accordance with the provisions of state law regarding said corporation or road districts. ( 3) Storm Development shall deposit with the appropriate governmental agency an irrevocable letter of credit in the amount of one million dollars ($1,000,000) in the aggregate with respect to the roadway needs for the land in this District and the San Marcos Municipal Utility District No. 1 at the time plans are approved for construction to be utilized to pay construction costs or construction-related costs for the Blanco River Bridge at 1-35 and the 1-35 interchange at the proposed parkway and to be drawn on by such agency at such time as the construction contract for the parkway from Interstate 35 to Ranch Road 12 is awarded. H. When a written transit agreement is executed by the City and/or Southwest Texas State University and the property owners' association within the District, Storm Development agrees to provide bus stop sites as required by the agreement in order to facilitate transportation within the District and surrounding areas. Storm Development agrees to donate a five acre site as shown on the Land Plan of the San Marcos Municipal Utility District No. 1 for a rail transit station for a rail transit system between the City of Austin, Texas and the City of San Antonio, Texas, at such time as said station may be required for completion of the transi t system. 1. Storm Development and the City shall each contribute an equal cash contribution of $10,000 in the aggregate per year for five years from the date the first industry locates within the boundaries of this District and the San Marcos Municipal Utility District No. 1, which contribution shall be made to any industry or industries located within the Districts and shall be for the purpose of establishing or maintaining an employee training program for existing San Marcos residents. This commitment to contribute said sums shall be contingent upon acceptance of the contribution by said industries. The division of the $10,000 among various industries within the Districts shall be determined by mutual agreement of Storm Development and the City based upon plans presented by the individual industries for such training programs. J. Storm Development agrees to participate in an affordable housing plan for low income families which the City may develop which shall be applicable generally within San Marcos in the future by ordinance, as amended from time to time. K. Storm Development, the City and the District acknowledge and agree that it is in the best interest of the residents and inhabitants of the District to obtain the level of fire protection services in the District that will provide to the property in the District the fire insurance benefits of the City's key rating by the State Board of Insurance. The parties further acknowledge that fire protection service provided by the City to the District and other areas in the region would accomplish that objective. Accordingly, the City agrees to ccoperate with the District in developing a method for the City to provide or assist in providing fire protection services in the District pursuant to the provisions of the Texas Water Code and the Interlocal Cooperation Act, Art. 4413 (32c), V.T.C.S. The District agrees to seek authorization to contract with the City for the City to provide or assist in providing fire protection services in the District and to initiate proceedings to obtain such authorization as soon as possible after creation of the District is approved by the Texas Water Commission. The parties agree that pending the development of the plan between the District and the City for the property in the District, such services may be provided on an interim basis by another enti ty.
