<br />15 <br /> <br /> <br />OHDINANCE 1985-119 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF 'IRE CITY OF SAN <br />HARCOS, TEXAS, GRANTING 'IRE CONSENT OF 'IRE CITY OF SAN <br />MARCOS 'lD THE CREATION OF A MUNICIPAL UTILITY <br />DIS'IRICT: HAYS COUNTY MUNICIPAL UTILITY DISTRICT NO.2 <br />SUBJECT TO VARIOUS TERMS AND CONDITIONS SET FORTH IN <br />A SEPARATE AGREEJVIENT HADE A PART OF THIS ORDINANCE; <br />SUSPENDING 'IRE PULE PEQUIRIN::; 'IRE READING OF ORDINANCES <br />ON 'IRREE (3) SEPARATE DAYS; AND DECLARING AN EMERGENCY. <br /> <br /> <br />vVHEREAS, pursuant to .section 54.016 of the Texas Water Code, the <br />City Council of the City of San Harcos, Texas, (hereinafter the "City") <br />has adopted Ordinance No. 1984-107 (the "Ordinance") establishing a <br />City policy on the creation of water districts within the <br />extraterritorial jurisdiction of the City; and, <br /> <br />WHEREAS, a petition for the consent of the City to the creation of <br />a municipal utility district to be known as Hays County Municipal <br />Utility District No.2 (the "District") to include the land described <br />1n Attachment "1" , has been filed with the City, and all of said <br />land 1S within the extraterritorial jurisdiction of the City¡ and, <br /> <br />WHfl~EAS, the City Council of the City has evaluated the petition <br />for consent to the creation of the District 1n accordance with the <br />policy set forth 1n the Ordinance and determined that the proposed <br />District substantially conforms to the policy except for those matters <br />specifically addressed in the agreement¡ and, <br /> <br />WHEREAS, certain proposed docuTI1ents and agreeTI1ents pertaining to <br />this matter have been prepared by the District's proponents with <br />participation by the City's staff and have been reviewed by the City <br />Council; now, therefore, <br /> <br />BE IT ORDAINill BY 'IRE CITY COUNCIL OF 'IRE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the tenns and conditions of a proposed <br />agreement granting the consent of the City Council to the <br />creation of Hays County Hunicipal Utility District No.2 between said <br />City and the owners and developers of the property to be included <br />1n the proposed district, a copy of said proposed agreement being <br />attached hereto and incorporated herein for all purposes as <br />Attachment No.1, are hereby in all things approved. <br /> <br />SECTION 2. That the Hayor, Elnmie Craddock, be, and she lS <br />hereby, authorized to execute said agreement enumerated in .section <br />1 above, and any and all documents and instrurænts incident <br />thereto. <br /> <br />SECTION 3. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions of <br />the Charter requiring that ordinances shall be presented at three <br />separate TI1eetings and that no ordinance shall become effective until <br />the expiration of ten (10) days following the date of its final <br />passage be suspended, and these provisions are hereby suspended, and <br />this Ordinance shall take effect and be in full force and effect from <br />and after its adoption and after its publication in a newspaper of <br />general circulation within the City. <br /> <br />PASSED, APPROVED AND ADOPTED this 25~y of November, 1985. <br /> <br />~~ <br />) Elnmie Craddock <br />Attes~ Þ Mayor <br /> <br />~K. \bmack' ð~ <br /> <br />City.secretary J <br /> <br /> <br />~-~.~ <br /> <br />Lamar W.
