<br /> C. Developer and the District agree to continue to <br /> cooperate and to work with the City to plan, fund and construct <br /> the Service Plan and Regional facilities in which the District <br /> and the City will participate in the future. <br /> D. It is understood and agreed by the parties that the <br /> Developer or the District, as appropriate, and the City intend to <br /> enter into an agreement for the operation of the utility systems <br /> in the District as set forth in Article IV below. The Developer <br /> or the District, as appropriate, and the City shall agree to <br /> cooperate in the establishment of water and wastewater rates and <br /> in the collection of the revenues from customers in the District. <br /> The City shall bill and collect water and wastewater rates from <br /> customers in the District on behalf of the Developer or the <br /> District, as appropriate, and itself on a monthly basis. The <br /> City or Developer, as appropriate, and the District shall agree <br /> to set and charge rates to the customers in the District from <br /> time to time in an amount sufficient to cover the City's water <br /> and wastewater rates (which rates shall not exceed the City's <br /> "in-city" rates) and an additional amount to meet the District's <br /> revenue requirements for administration, maintenance of <br /> facilities, debt service and any other revenue needs of the <br /> District. The Developer's or the District's portion of the rates <br /> shall be paid to the Developer or the District, as appropriate, <br /> by the City on a monthly basis. The City agrees that its records <br /> shall be open to inspection by the District's auditors in <br /> compliance with the auditing requirements of the Texas Water <br /> Commission. <br /> E. ( 1) Developer agrees to finance one-half of the <br /> City's pro rata share of year 1990 Regional facilities as set out <br /> and specifically delineated in the Service Plan in an amount not <br /> to exceed Five Hundred Thousand Dollars ($500,000.00) for water <br /> and wastewater improvements in addition to initially financing <br /> the District's share of the Regional facilities; provided, <br /> however that in consideration of the payment of such amount, the <br /> -9- <br />
