<br /> ARTICLE XIII <br /> SEVERABILITY AND ENFORCEABILITY <br /> The provisions of this Agreement are severable and, in <br /> the event any word, phrase, clause, sentence, paragraph, section <br /> or other provision of this Agreement, or the application thereof <br /> to any person or circumstance, shall ever be held or determined <br /> by a court of competent jurisdiction to be invalid, illegal or <br /> unenforceable for any reason, the remainder of this Agreement <br /> shall remain in full force and effect and the application thereof <br /> to any other person or circumstance shall not be affected <br /> thereby. The invalid, illegal or unenforceable provision shall <br /> be reviewed and rewritten to accomplish the parties' original <br /> intent as nearly as possible. <br /> In the event that the Texas Water Commission determines <br /> that any provision of this Agreement is beyond the scope of the <br /> Texas Water Code, the City, Developer and the District agree to <br /> immediately amend this Agreement to conform to such ruling or <br /> decision and to accomplish the parties' original intent as nearly <br /> as possible. <br /> ARTICLE XIV <br /> COOPERATION OF PARTIES <br /> This Agreement is for the benefit of the City, the <br /> District, and Developer, its successors and assigns, and shall <br /> not be construed to confer any benefit on any other party except <br /> as expressly provided herein. In furtherance of and to <br /> accomplish the purposes and objectives of the orderly development <br /> of the District and the City's North Service Area, <br /> regionalization of services, and economy and efficiency in <br /> providing municipal services to the District and the City's North <br /> Service Area, the parties hereto agree to cooperate with each <br /> other and to coordinate their activities involving the Texas <br /> Water Commission and other parties, both public and private, in <br /> obtaining approval for the creation and operation of the District <br /> in accordance with the terms and provisions of this Agreement. <br /> -28- <br />
