District shall, at the same time, file with the City Manager of the City or his designee a copy of the engineering report and any other documents indicating the bonding authority being sought. Appropriate City staff shall review such documents for compliance with this Agreement, the engineering report submitted in support of the bond application and other related documents on file with the City. ARTICLE III WATER, WASTEWATER AND DRAINAGE FACILITIES A. It is understood and acknowledged that the City through an agreement with Developer or the District, as appropriate, will provide water and sewer service to the property within the District through the use of facilities to be constructed in accordance with the North San Marcos Service Area Plan (the "Regional facilities"), a copy of which is attached hereto as Exhibit "c" and incorporated herein by reference ( "Service Plan"). At the times and in the manner requested by Developer or District, as appropriate, the City agrees to sell and deliver to the property within the District all water which may reasonably be required for domestic and commercial purposes by users within the District, and to collect, transport and treat the wastewater generated by the development within the District. City agrees that it has the responsibility and obligation to apply for and acquire the wastewater discharge permit required to carry out the intent of this Agreement. City further agrees to operate and maintain the water and wastewater facilities, both within and outside the District, in accordance with all local, state and federal statutory and regulatory requirements and standards. It is understood and acknowledged by the parties that the City has granted consent to creation of four ( 4) municipal utility districts to be located generally north of the City's corporate limits and within its extraterritorial jurisdiction.
