<br /> the S~ecial Record Date by United states Mail, first class postage <br /> prepa1d, to the address of each Holder of a Bond appearin~ on the <br /> books of the Paying Agent/Registrar at the close of bus1ness on <br /> the last business day preceding the date of mailing of such <br /> notice. All payments of principal of, premium, if any, and <br /> interest on this Bond shall be in lawful money of the United <br /> states of America and shall be made by the Paying Agent/Registrar <br /> by check or draft sent on or prior to the appropriate date of <br /> payment, by united states mail, first class postage prepaid, to <br /> the registered owner hereof on the applicable dates specified, at <br /> the address appearing on the Registration Books or by such other <br /> method, acceptable to the Paying Agent/Registrar, requested by the <br /> registered owner hereof, at the Holder's risk and expense. If a <br /> date for the payment of the principal of or interest on this Bond <br /> is a Saturday, Sunday, le~al holiday, or a day on which banking <br /> institutions in the city 1n which the Paying Agent/Registrar is <br /> located are authorized by law or executive order to close, then <br /> the date for such payment shall be the next succeeding day which <br /> is not a Saturday, Sunday, legal holiday, or day on which such <br /> banking institutions are authorized to close; and payment on such <br /> date shall have the same force and effect as if made on the <br /> original date payment was due. <br /> (iii) The Initial Bond shall be numbered T-l. <br /> section 10. DEFINITIONS. Throughout this Ordinance the <br /> following terms as used herein shall have the meanings set forth <br /> below, unless the context clearly indicates otherwise: <br /> (a) "City" means the City of San Marcos, Texas; <br /> (b) "City Council" or "Council" means the governing <br /> body of the City; (c) "Bonds" means the $730,000 City of San Marcos, <br /> Texas, Combination Tax and Revenue Refunding Bonds, Series 1985, <br /> dated December I, 1985, authorized by this Ordinance; <br /> (d) The term "Bond" additionally means any obligation <br /> of the City authorized to be issued by this Ordinance, whether <br /> initially delivered or issued in exchange for, upon transfer of or <br /> in lieu of, any Bond previously issued; <br /> (e) The term "Ordinance" means this Ordinance; <br /> (f) The term "Initial Bond" means the Bond authorized <br /> to be issued pursuant to this Ordinance, which has the <br /> Registration certificate executed by or on behalf of of the <br /> Comptroller of Public Accounts of the state of Texas endorsed <br /> thereon; <br /> (g) The term "Initial Date" means the date of the <br /> Bonds, as provided in section 2 of this Ordinance; <br /> -11- <br />
