<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP)
<br /> OF THE MASTER PLAN OF SAID CITY FROM LOW DENSITY
<br /> RESIDENTIAL 'ill COMMERCIAL FDR ThO (2) TRACTS OF LAND
<br /> CONSI STI NG OF A 'illTAL OF 1.57 ACRES MORE OR LESS, AND
<br /> FROM IDiI DENSITY RESIDENTIAL 'ill OFFICE AND PROFESSIONAL
<br /> FOR ONE (1) TRACT OF LAND CONSISTING OF 0.59 ACRES,
<br /> MORE OR LESS, ALL OF SAID TRACTS BEING A fORTION OF
<br /> THAT 49.48 ACRES OF LAND CONVEYED 'ill KENNETH D. RICE
<br /> BY KENNETH V. KRAUS BY DEED DATED MAY 26, 1983 AND
<br /> RECORDED IN VOLUME 394, PAGE 483, HAYS COUNTI DEED
<br /> RECORDS, AND BEING IDCATED ON THE SOUTH SIDE OF RANCH
<br /> ROAD 12; APPROVING THE PERMIT GRANTED BY THE PLANNING
<br /> COMMISSION FDR THE SAN MARCOS RANCH PLANNED UNIT
<br /> DEVELOPMENT; MAKING THE FINAL DEVELOPMENT PLAN OF SAID
<br /> PLANN ED UNIT DEVELOPMENT A PART OF THE OFFICIAL ZONING
<br /> MAP OF SAID CITY; AND DECLARING AN EFFECTIVE DATE.
<br /> WHERFAS, on August 20, 1985, the Joint Planning and Zoning
<br /> Commissions of the City of San Marcos held a public hearing r~Jarding a
<br /> request to amend the Future land Use Plan (Map) of the Master Plan
<br /> from Low Density Residential Use to Commercial Use for two (2)
<br /> tracts of land consisting of a total of 1.57 acres, more or less, and
<br /> from Low Density Residential Use to Office and Professional Use
<br /> for a 0.59 acre tract of land, more or less, all of said tracts being a
<br /> ¡;:x::>rtion of that 49.48 acres of land conveyed to Kenneth D. Rice by
<br /> Kenneth V. Kraus by deed dated May 26,1983 and recorded in Volume
<br /> 394, Page 483, Hays County Deed Records; and,
<br /> WHEREAS, subsequent to said public hearing on said date, said
<br /> Commi ss ions did, on August 20, 1985, consider said request and
<br /> voted to approve the same and has recommended that such request be
<br /> approved by the City Council of said City; and,
<br /> WHEREAS, said City Council held a public hearing on the 14 day
<br /> of November , 1985, regarding such request; and,
<br /> WH EREAS, all requirements of the Master Plan pertaining to
<br /> amendments have been met; and,
<br /> WHEREAS, on August 20, 1985, the Planning Commission of said City
<br /> approved and accepted the Final Development Plan and granted a permit
<br /> for the San Marcos Ranch Planned Unit Development; and,
<br /> WHEREAS, said City Council hereby finds and determines that the
<br /> adoption of the following Ordinance is in the interest of the public
<br /> health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. 'That those tracts of real property located in San
<br /> Marcos, Hays County, Texas, and more particularly described in Exhibits
<br /> 1 and 2 which are attached hereto and incorporated herein for all
<br /> purposes, which are in an area shown on the Future land Use Plan (Map)
<br /> of the Master Plan of the City of San Marcos as Low Density Residential
<br /> shall be shown on said map as Commercial.
<br /> SECTION 2. 'That that tract of real property located in San
<br /> Marcos, Hays County, Texas, and more particularly described in Exhibit
<br /> 3 which is attached hereto and incorporated herein for all purposes,
<br /> which is in an area shown on the Future land Use Plan (Map) of the
<br /> Master Plan of the ci ty of San Marcos as Low Density Residential
<br /> henceforth shall be shown on said map as Office and Professional.
<br /> SECTION 3. 'That the permit granted by the Planning Commission of
<br /> said City for San Marcos Ranch Planned Unit Development is hereby in
<br /> all things approved.
<br /> SECTION 4. 'That the Final Development Plan attached to this
<br /> ordinance shall become part of the official zoning map of the City of
<br /> San Marcos.
