7 ORDINANCE 1985-134 AN ORDINANCE OF THE Crry COUNCIL OF THE CITY OF SAN MARCOS, TEXAS REPEALING ARTICLE IV. DEMOLITION, VACATION OR REPAIR OF SUBSTANDARD BUILDINGS, OF CHAP/1'ER 5 OF THE CODE OF ORDINANCES OF SAID CITY AND SUBSTITUTING THEREFOR A NEW ARTICLE IV; MAKING AMENDMENTS '1'0 rrHE CODE ADOPTED IN ARTICLE IV; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE C rTY OF SAN MARCOS, TEXAS: SECTION 1. That Article IV., Demolition, Vacation Or Repair Of Substandard Buildings, of Chapter 5 of the Code of Ordinances of the City of San Marcos, Texas is hereby repealed. SECTION 2. That the following is hereby adopted as Article IV of said Chapter of said Code which shall read as follows: ARTICLE IV. DEMOLITION, VACATION OR REPAIR OF SUBSTANDARD BUILDINGS DIVISION 1. GENERALLY Sec. 5-70. Adopted. There is hereby adopted by the city for the purpose of establishing rules and regulations applicable to all unsafe buildings, or structures, and which shall apply equally to new and existing conditions, that certain building abatement code known as the Standard Unsafe Building Abatement Cod e, being particularly the 1985 edition thereof, published by the Southern Building Code Congress International, Inc., 900 Montclair Road, Birmingham, Alabama 35213-1206, and as hereafter modified or amended, a copy of which code has been, and all amendments thereto shall be, filed l.n the office of the city secretary of the City of San Marcos, and the same are hereby adopted and incorporated as fully as if set out full length herein, and from and after the effective date hereof the provisions of said code shall be controlling within the corporate limits of the city and its extraterritorial jurisdiction, subject to the laws of the State of Texas. DIVISION 2. AMENDMENTS Sec. 5-75. Generally. That building abatement code adopted by section 5-70 is hereby amended as set out in this division. All references to section numbers in the text of this division shall be construed as if followed by the words "of the building abatement code" unless clearly indicated to the contrary. Sec. 5-76. Section 101.4.2. Section 101.4.2 of said code is amended to read as follows: "Alterations, repairs or rehabilitation work shall not cause an existing building to become unsafe as defined in Section 202. " Sec. 5-77. All references to "Fire Official". All references to the "Fire Official" l.n said code are hereby amended to read "Fire Marshal" .
