<br /> 7 <br /> ORDINANCE 1985-134 <br /> AN ORDINANCE OF THE Crry COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS REPEALING <br /> ARTICLE IV. DEMOLITION, VACATION OR <br /> REPAIR OF SUBSTANDARD BUILDINGS, OF <br /> CHAP/1'ER 5 OF THE CODE OF ORDINANCES OF <br /> SAID CITY AND SUBSTITUTING THEREFOR A NEW <br /> ARTICLE IV; MAKING AMENDMENTS '1'0 rrHE CODE <br /> ADOPTED IN ARTICLE IV; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE C rTY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That Article IV., Demolition, Vacation Or <br /> Repair Of Substandard Buildings, of Chapter 5 of the Code of <br /> Ordinances of the City of San Marcos, Texas is hereby <br /> repealed. <br /> SECTION 2. That the following is hereby adopted as <br /> Article IV of said Chapter of said Code which shall read as <br /> follows: <br /> ARTICLE IV. DEMOLITION, VACATION OR REPAIR OF <br /> SUBSTANDARD BUILDINGS <br /> DIVISION 1. GENERALLY <br /> Sec. 5-70. Adopted. <br /> There is hereby adopted by the city for the <br /> purpose of establishing rules and regulations <br /> applicable to all unsafe buildings, or structures, <br /> and which shall apply equally to new and existing <br /> conditions, that certain building abatement code <br /> known as the Standard Unsafe Building Abatement <br /> Cod e, being particularly the 1985 edition thereof, <br /> published by the Southern Building Code Congress <br /> International, Inc., 900 Montclair Road, <br /> Birmingham, Alabama 35213-1206, and as hereafter <br /> modified or amended, a copy of which code has been, <br /> and all amendments thereto shall be, filed l.n the <br /> office of the city secretary of the City of San <br /> Marcos, and the same are hereby adopted and <br /> incorporated as fully as if set out full length <br /> herein, and from and after the effective date <br /> hereof the provisions of said code shall be <br /> controlling within the corporate limits of the city <br /> and its extraterritorial jurisdiction, subject to <br /> the laws of the State of Texas. <br /> DIVISION 2. AMENDMENTS <br /> Sec. 5-75. Generally. <br /> That building abatement code adopted by section <br /> 5-70 is hereby amended as set out in this division. <br /> All references to section numbers in the text of <br /> this division shall be construed as if followed by <br /> the words "of the building abatement code" unless <br /> clearly indicated to the contrary. <br /> Sec. 5-76. Section 101.4.2. <br /> Section 101.4.2 of said code is amended to read <br /> as follows: <br /> "Alterations, repairs or rehabilitation work <br /> shall not cause an existing building to become <br /> unsafe as defined in Section 202. " <br /> Sec. 5-77. All references to "Fire Official". <br /> All references to the "Fire Official" l.n <br /> said code are hereby amended to read "Fire <br /> Marshal" . <br />
